False accusation of theft

Answered 7 years and 7 months ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Libel, Slander And Defamation
You should work with the dealership and explain what happened. Be clear that you were not involved in the theft. This is your best opportunity. The dealership can terminate your employment at any time and for no reason. Ed Dimon, Esq.

The simple answer to your question is: Maybe. I'd have to meet with your fiancé to actually review the facts, and how he can prove those facts. Having to prove the facts about the statement will probably have to include working with people with his new employer, who may not want to get involved. Also, one might have to subpoena the test records. Your fiancé should contact me about setting an initial appointment, as his situation involves major factual and procedural issues. These are issues that we can discuss. If he is interested in pursuing the matter further, I offer an initial 1/4 hour consultation without charge, and a 1/2 hour consultation for $50. If he wants to set an appointment for the initial consultation, feel free to telephone, or email, my office. โ€จDon't wait any longer, give a call and let's getting working to protect your fiancé's reputation. โ€จโ€จDavid R. Florida has a statutory requirement that must first notice the publication so that it can print a retraction   Why anyone would not do so immediately is beyond me unless the person was more interested in a law suit instead of correcting the error in publication

I think the pertinent question is "what is your place of business" that you are waving his entry fee to and what do you do for a living? Depending on that answer, there may or may not be damage to your reputation, and assuming there is you would need to decide whether its worth spending thousands of dollars on legal fees to sue him over his comments, knowing you might not see any money unless he wins the lottery. If so - then you simply need to hire a lawyer at an hourly rate/retainer and  take him to task. ... Read More

Not sure what the question actually is. While there is a threat - there is no action and defamation by definition described.

Congratulations on overcoming this hurdle.  I am not sure what your question is but I am a bankruptcy attorney and I handle matters like this frequently.  If you do wish to sue your ex, that is definitely something we can entertain.  However, just coming out of a bankruptcy, you should be aware that this file would be billed hourly and could not be a flat fee or contingency.  Please feel free to contact my firm and I if we can be of assistance.... You will most likely need to just invest the money needed to file a lawsuit and go from there. Most such cases don't get resolved with casual discussions unless there is public retraction

It hard to deal rationally with nut bags. You may have to spend a good deal of money on seeking enforcment of the stalking issue in the state she resides in. You may also want to hire a psychiatrist as an expert to see how they think you should handle this based on her psych profile. Sometimes, responding to such people is the WORST thing to do. ... How can I protect myself in this situation?

Answered 7 years and 9 months ago by attorney Lori Nevias   |   1 Answer   |  Legal Topics: Libel, Slander And Defamation
Much more information is needed in order to answer your question. What's not clear is what type of job/profession you have, type of facility you work in, the accusations against you, whether there was an investigation/inquiry, whether the client was actually discharged involuntarily or is still in the facility, whether you are on a paid or unpaid leave of absence, and the length of your leave of absence.  If you are on an extended unpaid leave of absence and you can prove the client lied, you may have an action for slander against the client.  The statute of limitations is one year from the time of the slander, so keep that in mind. Depending on where you are employed, there should be procedures in place for investigating the conduct of which you were accused, and your employer is responsible for following those procedures and conducting an investigation. If the procedures were not followed and that results in loss of salary, and you can prove that had the procedures been followed you would have been exonerated, you may also have an action for money damages against your employer. ... Nope. This is price of a free society. You can discuss this with UPD about the security aspects of doing so, but there is no lawsuit here and any effort to push the envelope on such would entail you spending thousands of dollars in legal fees simply to make a point.

You can seek a restraining order in criminal court.  These are done without a lawyer.  Ask the court clerk to help.

Probably a general civil trial lawyer to address such an issue. Be prepared to pay out of pocket for such a lawyer as this is not likely a contingent fee case.
