I presume you are asking if you can sue the secretary.   One of the elements of any lawsuit is damages. I am unclear what they are.   I do not know how you will provde that she is the one who did it.   Also there is the issue of collecting damages. Does she have any assets beside a residence, a car she owes money on, a salary as head of household protected from garnishment/   These are questions any lawyer who is considering handling the matter on a contingency basis would ask.... My question is, have you actually been suspended? From what you say, you have been. As such, I don't see any wrongful comment, the comment is in fact true. As such, I don't see defamation. Now, if there is something in your personnel policy about not disemminating such information, you might have a basis for invasion of privacy, public ridicule, or the like. First, to answer your question most directly, the type of lawyer you need if someone is defaming your character is a lawyer with experience handling libel, slander, and defamation claims. You're already here on Lawyers.com, so you're in the right place. I also need to tell you, however, that if the source of the defamation is a "slanderous bill of particulars," your remedies are most likely limited to defending yourself in court and (hopefully) winning the case. Statements made in court proceedings are generally immune from defamation suits -- see https://www.virginiadefamationlawyer.com/2014/01/absolute-judicial-privilege-extends-outside-the-courtroom.html for a short article I wrote on this topic not long ago. The statute of limitations for defamation claims in Virginia is only one year, and there is no "discovery rule" that might extend the period. So if the situation is serious as you say, and the statements being made about you are factually incorrect and not just expressions of personal opinion, then the time to speak to a lawyer is now. Other than that, make sure you have another lawyer willing to take the case first, lest you find yourslef with no lawyer. Two years is the time frame for defamation. BUT there may be issues if the article is continually republished. You will most likely have to hire a lawyer to some significant expense to sort this out if at all possible.
