An attorney has an obligation to keep his client informed of the status of their case.  So too must the client stay in contact with their attorney. I suggest that you email your attorney asking for a case status and any other questions or concerns you may have regarding the matter.  You should also call your attorney on the same topics.  If you do not receive a reasonable response you can either contact the louisiana office of disciplinary counsel with your complaint or ask another lawyer for assistance in discovering the status of your case.  Good luck. ... My Father was killed on the job due to companies negligent. Is there anything that we can do?

Answered 9 years and 5 months ago by Gerald Gregory Lutkenhaus (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
Ms. Dodson when your father was killed at work there would be two possible claims. One claim would be for workers' compensation. This would be 500 weeks of compensation. The other possible claim would be a personal injury claim for wrongful death. This type of claim would depend upon the circumstances of your father's death. You can contact me for additional details. I am afraid if your father's death was solely due to the negligence of the employer or the employees of the employer then a personal injury claim may be barred by the fact the company has workers' compensation insurance. I provide more information at www.virginiadisabilitylawyer.com. ... Read More

Wrongful Death - Fatal Fire

Answered 9 years and 9 months ago by Mr. Christopher Edward Clark (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
Dear Anonymous,   Whether there is a viable claim for your father's wrongful death is going to depend on the specific facts of how the fire started.  If there is evidence that the homeowner was negligent, then there likely would be a claim.  A finding of "undetermined" is quite common, but it does not necessariy rule out possible causes.  I would be happy to discuss the details of this with you if you would like to give me a call at your convenience.  There is no charge for the consultation, and if we were to accept the case, it would be on a contingency fee basis, meaning you only pay if we are able to settle the claim, or win at a trial.   Chip... can i get money from my settlement before it is taxed?

Answered 10 years ago by Jerry Meyers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
There should be no federal tax on wrongful death claim. there may be an inheritance tax on any suvival claim.  there is some times a dispute concerning how the money is to be divided between wrongful death and survival.  Ask your lawyer what's holding up the decision. What is preventing a preliminary distribution. Usually a death claim requires court approval. the tax matter is ordinarily decided at that time.   I'm not providing legal advise.  My Practice is in Pa.  These are simply issues you can discuss with your lawyer. I frankly don't understand why you haven't talked to your lawyer about this.... Read More

Family died in a plane crash in Utah. Their residence is in Az. Does the family need an Attorny in Utah or Az? Can siblings file a wrongful death?

Answered 10 years and a month ago by Mr. Freddy A Saavedra (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
This sounds like a tragic accident and I am sorry for your loss. The answer to this question is a bit complicated. There are many things to consider when hiring an attorney, such as what exactly gives rise to the claim? Was it something that happened in Arizona on a flight to Utah or was it a flight that originated in Utah with no connection to Arizona? Where do the next of kin reside? The answer to the second question depends on the first in a way. In other words, where the suit is filed may determine who can bring a wrongful death claim. While this may not be a satisfactory answer the reality is that more information will be needed to determine a good course of action. Most if not all wrongful death attorneys should be able to provide a free consultation to review the answers to the above questions. I would begin with an attorney in the same state as the person seeking answers.... Read More

Answered 10 years and a month ago by Brent Allen Wieand (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
You should consult with an attorney who can investigate what insurance may cover this tragic accident. There may be several routes to recover compensation, regardless of the defendant's assets, depending on the circumstances.
