You absolutely, urgently, need to consult with a wrongful death lawyer. You do not mention the date of his death. But there is a strict 2 year statute of limitations after any Florida wrongful death case (and that can vary sometimes depending on the date of discovery of the negligence, but that doesn't appear to apply to your situation, so I think you have a 2 year statute of limitations). But you shouldn't wait because critical evidence can disappear very quickly. We provide free telephone consultations to get to the bottom of what might be possible in your situation. my deepest condolences and sympathies on the loss of your sister. The first issue is who in the family would be the person who would be guardian ad litem to act on behalf of your sister. If she had a spouse or adult child then u may not be the appropriate person. If no parent or spouse or adult child survived your sister, then you would be the most appropriate party to handle this case. The trucking companies and truck drivers have a way of getting rid of evidence that you will need to support your case down the road, such as the driver's qualification file, pre trip inspection reports, and the driver's logs. My condolences to you and your family for the loss of your son. Your question raises several issues that will require a skilled personal injury/wrongful death attorney. If multiple drivers and or shooters were involved, there could be multiple insurance policies that may offer coverage. However, assuming there was insurance, it is likely that the insurance companies will want to deny coverage as a shooting could be considered an "intentional act," and thereby excluded from coverage.
