My mother died in 2009, a wrongful death, is it too late to file lawsuit

Answered 7 years and 11 months ago by Mr Robert W. Hughes, Jr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
It is probalby too late to file for her wrongful death. The statute of limitations and the statute of repose both preclude you from filing the suit.

If cousin signed an insurance check from deceased son's insurance co. can she still pursue a wrongful death claim?

Answered 8 years ago by Mr Robert W. Hughes, Jr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
The first thing she should do is see an attorney about the child's claims that she might be authorized to pursue.  She needs to look into opening an estate for her son for the benefit of his daughter.  Urge her to seek repreesentation  quickly.

FHP Negligent

Answered 8 years ago by attorney Tina Michelle Willis   |   3 Answers   |  Legal Topics: Wrongful Death
You absolutely, urgently, need to consult with a wrongful death lawyer.  You do not mention the date of his death.  But there is a strict 2 year statute of limitations after any Florida wrongful death case (and that can vary sometimes depending on the date of discovery of the negligence, but that doesn't appear to apply to your situation, so I think you have a 2 year statute of limitations).  But you shouldn't wait because critical evidence can disappear very quickly. We provide free telephone consultations to get to the bottom of what might be possible in your situation.  Only certain survivors can recover under Florida's wrongful death statute (for more info, wrongfuldeathattorneyorlando.com).  There is absolutely no way you can handle this case on your own.  Don't try.  At least call a lawyerr to find out what might be possible for you, in this case.  If he had any wife or children, ideally they would be involved in hiring the lawyer, too.   Tina Willis Law - Orlando, 390 N. Do I possibly have a wrongful death case if my Son overdosed at a known drug abusers house and later died?

Answered 8 years and 2 months ago by Dena Rachel Young (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
This is terribly sad, I am so sorry.  What did he overdose on? If it was an opioid, he may have a case. Need to know what exactly he overdosed on... if a prescription opioid, was it prescribed to him? For what?

my deepest condolences and sympathies on the loss of your sister. The first issue is who in the family would be the person who would be guardian ad litem to act on behalf of your sister. If she had a spouse or adult child then u may not be the appropriate person. If no parent or spouse or adult child survived your sister, then you would be the most appropriate party to handle this case. I would retain counsel on contingency to act on your behalf to achieve a successful and satisfactory result. Again my deepest sympathies. Stephen Black (407) 581 2581... Read More

This may be a very good case, pending more facts of course. You will need to prove that the cause of your wife’s fall was due to negligence on the part of your neighbor. If the facts bear that out then you can pursue a case for wrongful death against the neighbor. I am very sorry for your loss. Contact to discuss.... Read More

If you do not have a lawyer already, you should immediately get a consultation.  The trucking companies and truck drivers have a way of getting rid of evidence that you will need to support your case down the road, such as the driver's qualification file, pre trip inspection reports, and the driver's logs.  At a minimum, send them a certified letter advising them of the potential of litigation so they will eb faced with consequences if they get rid of evidence.  If you need a copy of a letter to send, give our firm a call.    James         ... What do I do with the records showing he was confused?

Answered 8 years and 8 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
You have the category as "wrongful death", which I assume that "he" (whoever that was) died. I am also assuming that you are in some way blaming the hospital for his death. Without knowing what the cause of death was, not sure whether he was walking or not played a role in his death.

The literature about this suggest there is no known cause, but the question here is whether your daughter had been diagnosed with epilepsy and treated appropriately.  But from the death alone, it would seem to be without more  facts and reviewing the medical records there is way for any attorney to conclude there even might be negligence by the neurologist.  Obtain the medical records and consult a lawyer.  ... Do you handle Negligence Act,or Personal Injury,or Wrongful Death Suits?

Answered 8 years and 10 months ago by Mr. Christopher Edward Clark (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Death
Dear Anonymous, My condolences to you and your family for the loss of your son.  Your question raises several issues that will require a skilled personal injury/wrongful death attorney.  If multiple drivers and or shooters were involved, there could be multiple insurance policies that may offer coverage.  However, assuming there was insurance, it is likely that the insurance companies will want to deny coverage as a shooting could be considered an "intentional act," and thereby excluded from coverage. Given the multiple issues presented by your son's untimely death, I would suggest that you call me and we can discuss the case in more detail.  I will be happy to give you a free evaluation of what you might expect if you were to pursue a lawsuit. Very truly yours, Chip Clark ... Read More
