if a wife file for a divcore because her husband had abandoned her will the husband get any of his wife retirement benefits

Answered 8 years ago by Samatha Granderson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
There is a marital property component to your retirement benefits and eventhough your husband abandoned the marriage there is a possibility that he will be entitled to his "marital share" of your retirement, just as you will be entitled to your "marital share", of his.

How can I collect back child support when my ex-husband works under the table for a company that is in his current wife's name???

Answered 8 years and 2 months ago by NA smsattorney@gmail.com (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family Law
You will need a competent and aggressive attorney that will go after your ex for child support. We go the extra mile for child support and child custody cases. Last case we had in MD was a child support and alimony case where we had to get $400,000 from the rich ex that was always getting away from paying his rightful share to his kids and ex wife. We were able to recover half, which is what he had anyway. We can certainly assist you. Feel free to give us a call for a free consultation. Thank You. Is parental kidnapping a serious issue and what is considered parental kidnapping?

Answered 8 years and 2 months ago by NA smsattorney@gmail.com (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family Law
Are you on the child birth certificate? How old is your son? Parental Kidnapping occurs when there is a custody established in court for the kids. However, as a parent, anyone can travel with the child anywhere so long it's not endangering the child or its wellbeing. If you feel the child is in danger, you need to contact the Police. If it's a domestic dispute and she ran away, you need to file an emergency motion to locate the child and establish custody. Please contact an attorney to work with you. Many attorneys will ask for an upfront payment of $3,000.00 Please keep in mind that not all lawyers are same. Therefore be very cautious as to which attorney or law firm you chose to work with. We are based in New York but my network of SMS ATTORNEYS does travel out of state for clients. If you would like to retain our services while on a limited budget, do let us know and we will try to do our best to offer payment plans option. Feel free to give us a call for a free consultation. Ahsan Syed answer and comments to questions are for general purposes only and do not constitute legal advice or establish an attorney-client relationship with SMS ATTORNEYS without a signed retainer. Deportation

Answered 8 years and 2 months ago by attorney Alan Lee, Esq.   |   1 Answer   |  Legal Topics: Immigration
Before the Trump administration, a common tactic was to request prosecutorial discretion from DHS to drop the removal proceedings. The chances of that happening are much less now, but perhaps your attorney can still give it a try. Even though it has been almost 10 years since you came to the US, you would not be eligible for cancellation of removal, the so-called ten-year green card, because the government stops counting time once you are served with a notice to appear in the immigration court. If you or your wife have any skills and/or education and can be sponsored by an employer (most likely through a labor certification), you could perhaps go to Canada or your home country and wait until all the papers are approved for you to interview at the home country consulate or embassy for immigrant visas for yourself and your wife. If Immigration never revoked or denied your F-1 and you just naturally fell out of status, you would not be barred for 3/10 years (assuming that you are not ordered removed) because of your overstay as unlawful presence for that purpose is only counted beginning from when U.S.C.I.S. denies or revokes the status or you receive an unfavorable ruling from the immigration court. Your other options are to apply for withholding of removal if you have been persecuted or have a probability of being persecuted in your home country because of religion, nationality, social group, political opinion or race, or for your wife to sponsor you to live in Canada. How can you get an extension to make a back payment for child support without being held in contempt

Answered 8 years and 3 months ago by NA smsattorney@gmail.com (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Support
You should have a lawyer with you throughout until the child turns adult age. Until then the child-parent will always be dragging you to court for one thing or another. I highly doubt that you will be able to get an extension for the payment. What you might be able to do is contact the other parent and explain the situation. This will be the only way you can get away from contempt. I would need to know more details but contact the other parent sounds like the most viable option. Above answer and comments to questions are for general purposes only and does not constitute legal advice or establishes an attorney-client relationship without a signed retainer. Please reach out to an attorney you are comfortable with working and discussing your case in more details. If you can not afford a private attorney, you may be eligible for a Pro Bono lawyer provided by some courts and if not, feel free to ask about our affordable payment plans.... Read More

Ordinarily, in a Maryland court, a court clerk will be directed to send a letter to a defendant notifying him, her or it that a motion has been made to enter an order of default. The letter will invite the party to state a valid defense, if there is one, to the complaint and explain the reason for noncompliance with the Rules of court. Assuming that a default is actually entered by the court, the case will be set for a hearing and the Plaintiff will be permitted to offer ex parte proof of damages suffered. The defaulting party will not be permitted to contest the evidence of damage presented at the hearing. Until, a judgment is entered after that hearing, assessing the damages awarded by the court, there is nothing to collect. If and when an award of judgment has been entered, one may seek to collect by interrogatories to the judgment debtor about their assets and location in order to make attachments on the assets. In addition, an oral sworn statement may be taken of the debtor for the same purpose. The Rules of court control how and the circumstances under which collection efforts may be undertaked using court process. In addition, the post judgment rate of interest in Maryland is 10 percent. Though not highly complicated, you may need to retain a lawyer to assist or to tell you what you must do to comply with requirements governing collection on a judgment. ... Read More

Can I sue Mens Warehouse for ruining my wedding

Answered 8 years and 4 months ago by attorney Bruce Robins   |   1 Answer
Anybody can sue anybody for anything, and I don't know the facts or how the weddding was ruined, but it is very unlikely that you can successfully sue Men's Warehouse for any kind of consequential damages, let alone emotional damages.  Direct damages would be those arising directly from the wrongdoing (e.g. you paid $1500 to rent tuxedos which they didn't provide, your direct damages would be the lesser of $1500 or the difference between $1500 and the amount you had to pay to get substitute tuxedos).  Consequential damages would be damages arising indirectly from the wrongdoing (e.g. because Men's Warehouse didn't provide the tuxedos, the wedding was delayed and you only got 3 hours at the reception hall when you had paid for 5).  These can only be recovered in particular circumstances which don't appear to be present here, and may be specifically excluded in your contract with Men's Warehouse - check your sales/rental paperwork.  Again, I don't know the facts, but you appear to be writing about emotional damages, i.e. you didn't actually lose any money, but you felt that your wedding wasn't all that you had hoped.  Absent some egregiius intentional wrongdoing, you can't recover these damages.... Can he really get full custody of the kids just because my house was dirty when I was sick and he has pictures?

Answered 8 years and 5 months ago by Aimee Carol Robbins (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
I doubt it. Custody is based on which parent can meet the best interests of the children. Hire an attorney to help you defeat your husband's pursuit of custody-especially if your husband has retained counsel.

If you have a question, it is not apparent from what you have written. In fact, what has occurred is not clearly enough explained to thoughtfully respond to a question were one evident. Perhaps you can try your question again by writing the circumstances giving rise to your question and in doing so assume no one knows anything about yor issue. Perhaps state the who, what, where, when, why and how of your grievance. The question will be more understandable. ... Read More
