How much will it cost to bring my girlfriend to the US from Dominican Republic?

Answered 6 years and a month ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Citizenship
Discuss your case with counsel anywhere in the USA to explore your options in a free phone consultation. For a fiancé visa you have to have met within 2 years of filing. But If you marry her then she can process at the overseas consulate. The fiancé visa takes a wee bit less processing time than a spousal visa but costs more for filing fees. ... Read More

If I win the DV lottery can I file for green card while waiting for H1B visa?

Answered 6 years and a month ago by attorney Alan Lee, Esq.   |   1 Answer   |  Legal Topics: Immigration
I suspect that if the only thing that is keeping you legal up to the date of filing an adjustment of status is the H-1B pending petition and you then withdraw the H-1B petition, U.S.C.I.S. could possibly give you problems on the adjustment by claiming that the H-1B filing did not give you legal nonimmigrant status where it was never approved. Who is listed as the father on your birth certificate?
Who is listed as the father on your birth certificate?
You've raised a lot of issues.  There is no need for an attorney to be present when your father gave or sold his stock to your sibling, however the contract would obviously be invalid if it is forged, if your sibling defrauded your father or used undue influence or duress to get your father to sign it, or if your father was not legally competent when he signed the document.  If you believe that any of these situations apply, you can sue to invalidate the contract, but you will have to prove the basis on which you claim the contract is invalid. ... Can I still apply for a green card with an expired passport in 2020?

Answered 6 years and 3 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Immigration
The issue in your case is whether your spouse is an American citizen. If you have overstayed your visa, etc,  that will not affect your citizen spouse from sponsoring you for a green card, unless other grounds of inadmissibility apply. Consider working with an attorney who can prepare the case from start to finish so that long delays or a denial can be avoided. Some of us are very affordable. Good luck. ... Read More

Assuming that your daughter is a US citizen and over the age of 21, and that you and your husband will be free from the deportation time and ten year bar for remaining illegally in the United States for over one year by the end of your processing, she would file an I-130 petition for each of you, and when those are approved by U.S.C.I.S., you would begin consular processing for the green card. (The 10 years must be satisfied by the time that you are interviewed by the consular officer). How do I file for a change of guardianship as a minor?

Answered 6 years and 4 months ago by attorney Terry Lynn Garrett   |   1 Answer   |  Legal Topics: Guardianship and Conservatorship
Your father is your natural guardian.  In most states he can sign a special power of attorney allowing you to live with your grandmother, allowing her to take you to the doctor and enroll you in school.  He can revoke it whenever he likes.  In many states you can become emancipated (freed from his natural guardianship) when you are 17 if you are self-supporting and living separately.  The Lambda office in your area may have other suggestions.... While many non-lawyers believe that a quitclaim deed transfers title, it generally does not.  It only foregoes a claim to property in dispute, such as an easement. At the time she signed, your mother's dementia may or may not have been sufficiently advanced for her to lack legal capacity to contract.  Dementia is being diagnosed earlier these days. Take the documents to a local probate lawyer for a second opinion.  Without seeing them, no one can advise you.... Read More
