If you husband is the at fault driver, it is my understanding that if he was injured he will need to be responsible for his own health care provider bills unless your husband has health insurance or is eligible to receive Personal Injury Protection benefits under your auto insurance policy.

If you purchased the Eric Insurance through an agent, I suggest that you ask the agent whether you are better off going through your auto insurance or handling the damage on your own. I do not know if the value of the vehicle is going to change whether you go through your auto insurance company of handle the damage on your own. If you repaired your vehicle using your own auto insurance collision or Uninsured Motorist property damage coverage, then have your insurance company make a subrogation claim against the auto insurance company for the vehicle of the teen driver. Your auto insurance company will be able to get back their money and your deductible.

If you were represented by an attorney, you should discuss with the attorney whether you will be successful on appeal and whether that attorney is willing to handle the appeal. My understanding of the law is that the insurance company for the at fault driver is only responsible to pay you for the fair market value of the total loss of your vehicle. I do not believe you can sue the other driver if his auto insurance company is paying you for the total loss. You can call the Maryland Insurance Administration for further confirmation.
