Tow truck damaged my car

Answered 12 years ago by Eric Neal Schloss (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You will need to speak with a traffic court attorney to determine whether all the tickets can be cleared because you admit that your handicap tag was expired. As to the tow truck causing damage to your vehicle, you will need to make a claim with DOTS.  Make sure you put DOTS on proper notice of your claim especially if it is a State of Maryland entity.  You also might be able to make a claim through your own auto insurance company for the damage done to your breaking system.  Then your insurance company might be able to go after DOTS to get back any money they paid you plus any deductible your were responsible for in making the claim against your auto insurance company.  Good luck with this matter.... Answered 12 years ago by Eric Neal Schloss (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
In general you can only sue the driver of the at fault vehicle.  But if the driver was working for the owner of the vehicle or was doing an errand for the owner of the vehicle, then you can also sue the owner of the vehicle.  In addition, if the owner of the vehicle negligently entrusted the vehicle to the driver, then you can also sue the owner of the vehicle.  Good luck with this matter.... Rental Car Proof of Insurance

Answered 12 years ago by Eric Neal Schloss (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
Under Maryland law, the rental car company has to have its own insurance on the rental vehicle.  If the accident was your daughter's fault, she will likely have to reimburse the rental car company for the damages caused to the rental vehicle and the loss of use of the rental vehicle to the rental car company.  If you daughter was covered under anyone the auto insurance policy of anyone else on the date of the accident, make sure the collision is reported to that insurance company.  As to whether the rental car company was in error for renting the car to your daughter, you should consult with an attorney familiar with dealing with rental car companies.  Good luck with this matter.... You will likely not get in trouble with law enforcement for lying about your boyfriend.  Your real focus should be on proving that the other driver is lying about how the collision occurred.  If you have not already done so, make sure your insurance company knows the truth about who was in your vehicle with you.  Good luck with this matter.... I am not sure what you mean by all the fees.  The 33 1/3 percent attorney fee comes out of any recovery (i.e. settlement or award from a trial).  Typically expenses incurred by the law firm and outstanding bills with health care providers usually also come out of any recovery.  Some lawyers do charge the clients a retainer for expected expenses to be incurred by the law firm.  Good luck with this matter.... can a insurance co. take you to court after 4 years after accident

Answered 12 years and 2 months ago by Eric Neal Schloss (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
It sounds like the insurance company for the other party is pursuing a subrogation claim against you for allegedly being at fault for the accident.  I suggest that you consult with a debt collection attorney so that you can determine if the insurance company for the other party can still pursue this matter even though the accident occurred in 2009.  It is likely the insurance company for the other party paid their insured as a result of you allegedly being at fault for the accident and still has time under the law to pursue their subrogation claim against you.  Good luck with this matter....
