What do I do if the auto insurance company of the driver is stalling in paying for damages on my vehicle?

Answered 12 years and 11 months ago by Mr. James Jenkins Mills (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
If you were injured, you should probably hire an attorney.  If you just have property damage, you just need to make sure you take pictures, and keep your receipts.  They will pay, eventually.  Good luck.

What will happen to me for driving while suspended even though I didn't cause the accident?

Answered 13 years ago by Erven T. Nelson (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Car Accident
You might get a citation for driving on a suspended license, which you can probably negotiate. It should not harm your personal injury case.

What's he minimum I should settle for? Who should I file the settlement or Lawsuit against in a single car accident?

Answered 13 years ago by Mr. James Jenkins Mills (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You almost certainly need to hire an attorney to handle this for you in order to make sure that you maximize your recovery.  Consultations are almost always free of charge for these types of claims, and the attorney will charge a contingency fee, meaning any payment the attorney receives is contingent on the outcome of your claim.  You have three years from the date of the accident to formally pursue the claim, but studies show that hiring an attorney earlier in the process is much better for your success.  You are also likely to have liens on payments made through government health care, and you will want an attorney to make sure those are handled properly.  I strongly recommend that you contact a personal injury attorney licensed in North Carolina soon.   Good luck going forward.   Jay Mills James J. Under Michigan law, until you either pay the judgment or file for bankruptcy and get the judgment discharged, you cannot get your driver's license back. If you get caught driving on a suspended license, you may go to jail.

What can happen to my niece who has hit a police officer if the case is taken to court?

Answered 13 years and a month ago by Ronald A. Steinberg (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Car Accident
She needs a competent criminal lawyer to represent her. She is supposed to be driving at a speed and in a manner to be able to deal with the adverse weather conditions. She will need to establish that the cop was not acting appropriately, such as not having flashers on, etc. If she can beat the case, she should not have any jail issues. However, she should also notify her auto insurance company, because when the cop files a civil law suit, she will want the insurance company to defend her in that case.... Read More

What would be a realistic settlement to ask for pain and suffering?

Answered 13 years and a month ago by Mr. Paul L. Whitfield (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Car Accident
Depends on facts, carrier, circumstances, amount of property damage, how many doctors seen, what doctors say (as well as bills) you might ask for 5 times the medical bills and be very happy if they give you 2 or 3 times the bills. all insurance companies now say they don't settle on the basis of multiples like that. it is generally true they no longer do. Get what you can and close the file and get on with your life. Both cases are modest and the settlements will not change your lives at all.... Read More

What would be a realistic settlement to ask for pain and suffering?

Answered 13 years and a month ago by Mr. Jon Ward (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Car Accident
It sounds like you are dealing with a bad situation, and I am sorry to hear that. Even given the detailed information you provided, it is impossible to determine the value of the cases for children. If they are still seeking treatment, it is likely that the cases are not ready to settle. The primary issue will be whether they are okay after all of the medical treatment. If they have any ongoing issues, those need to be documented and considered in the valuation of the cases.... Read More

Who pays the damage for a hit-and-run if the at-fault driver is not charged with damages?

Answered 13 years and a month ago by Mr. Paul L. Whitfield (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
Driver is liable for whatever damage he causes. Why do you people have some notion to the contrary? Every inquiry I get about hit and run seems to involve the driver who thinks if he can hide he avoids liability. You buy insurance. Insurance pays the damage. End of ballgame.why is this so hard to understand for the younger generation of drivers. You don't avoid liability by running, hiding, fudging, lying.. Buy insurance. Tell the company the truth, forget it and let them pay the damage. that is what insurance is all about,. That is what the system is all about.... Read More

vehicle accident

Answered 13 years and 3 months ago by Mr. Charles D. Scott (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
My answer is based on Florida law, and may be different in your state. In Florida we have "comparative" negligence. That means that you can be partially at fault in an accident and still recover damages, reduced by the amount of your own negligence. In states where the law is "contributory" negligence, if you contributed to the accident you cannot recover. So it will depend on the lawy in your state, if it is comparative you could still find a lawyer to file suit against the other driver. The obscured tail lights may be the key to your case....
