What type of attorney should I get if I get into an accident because my truck's brake caliber fell off?

Answered 11 years and a month ago by Mattias F. Johnson (Unclaimed Profile)   |   13 Answers   |  Legal Topics: Car Accident
Based on the nature of your question, the 'type' of attorney that would typically handle a case of this nature would be someone who specializes in personal injury, auto negligence cases. Many lawyers, and firms, in Michigan do not necessarily limit themselves to one 'type' of practice but those headings are what you would look for.... Read More

I recently got into a car accident with a suspened license and no insurance. What will happen next?

Answered 12 years ago by Carl P. Deluca (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You will probably be charged with driving while suspended.  That will likely result in a lengthening of your suspension and further fines.  In addition, you will not be able to get a license until you deal with any liability you may have for the accident or discharge that liability in bankrutpcy court.   There are other possibilities and I would have to know more details to be able to provide you with proper guidance.... How can I get my car from the impound lot after being on an accident driven by someone who stole it?

Answered 12 years and 4 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Car Accident
Your car is evidence of a crime, and that is why it is being held. I think you need to talk to a local criminal attorney because there is a way through the court system to ask the court to release your car.

How can I get my car from the impound lot after being on an accident driven by someone who stole it?

Answered 12 years and 4 months ago by Mr. Paul L. Whitfield (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Car Accident
There are no rules that I am aware of. The police or DA can always say the car is evidence. Why don't you get a lawyer who hangs out in traffic court or who knows the police or the people who operate the lot. Quit trying to do it the hard way.

Who should request for drug test after a commercial vehicle accident?

Answered 12 years and 5 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Car Accident
If the police suspect that drugs or alcohol was a factor in the incident, they can order a test. I do not believe that you have the "standing" to do so. However, if the other party required any medical treatment following the accident, with a proper court order, you could subpoena the other party's hospital records and if they were positive for a controlled substance or booze, you have terrific evidence to show to the judge or the jury.... Answered 12 years and 6 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   8 Answers   |  Legal Topics: Car Accident
Yes, you can sue the bad guy. You also need to reconsider letting your wife drive without a valid license. She could have been arrested and taken to jail, even though she was not at fault for the accident.

You might think they do not happen until they do? Please understand we are in a very different world than we were in even three years ago. They probably were not as courteous as they should have been. I would ask you what your history is too. Have you had some dealings with the police and court system in the past, like juvenile stuff? No the stop is within the law. There is not harassment case from what you report. I suggest you don't loiter around too much, particularly in alleys, no matter where they are.... Read More

Sue the weasel. The car was damaged while it was in his possession, and so he is responsible. If you had auto insurance, report it, and have them fix the car, and let them sue him. If you did not have auto coverage, then you sue him. It seems that you are well rid of him.
