If you’ve paid for the car in full but haven’t received the title, the seller is legally required to transfer it to you. Since the vehicle came from Mississippi, you’ll need to work with the Mississippi Department of Revenue, Title Bureau to verify who the titled owner is and whether there are any liens on the vehicle. Start by gathering all proof of payment—receipts, text messages, a bill of sale, or any written agreement. Then contact the Mississippi title office and explain that you purchased the car but the seller hasn’t transferred the title. They can tell you what forms to file, such as a bonded title application or complaint for failure to transfer title. If the seller refuses to cooperate, you can also report it to law enforcement or the state’s consumer protection division because keeping a title after full payment can be considered fraud. You may want to consult a Tennessee or Mississippi attorney who handles vehicle-title disputes to help you file the necessary paperwork or a small claims action to compel the seller to sign over the title. Acting quickly is important before your temporary tag or drive-out expires.... Read More

Does a insurance company have to pay

Answered 6 years and 7 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
The fact that the insurance company will not pay at this time, doesn't mean that you don't have a claim against the driver and owner. The insurance company only has to pay if the all of the conditions of coverage are met. If the driver, not the owner/insured, is not listed as an insured on the policy and does not have a drivers license, most insurance companies will not provide coverage. You can still sue the driver and the owner for damages. The insurance company might cave in and pay if you sue the owner/insured.... Read More

They can only garnish your check after they have sued you and gotten a judgment. If they obtain a judgment, you can file a slow pay motion asking the judge to determine how much you should pay each month. This will stop any garnishment.

I was hit by a 15 year old driver who had a permit. Car totaled. Nagging injuries for several weeks. What would be reasonable settlement?

Answered 7 years and a month ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
In this site, I try to answer questions and give general advise about the law. Since each case is fact specific, I avoid giving answers to specific cases because there might be facts that are not listed that might affect the outcome. Therefore, I can not tell you how much is a "reasonable settlement" in your case. I would suggest that you might want to speak with an attorney in your area to seek an answer to your question. Another alternative, is to Google your question. I did that and found some websites that might be of assistance to you.... Read More

Hiring an attorney and then trying to get a satellite of the area where the accident happened (if such even exists) would be expensive, probably more so then paying to have the other cars fixed.

My insurance will not pay for my car that was totaled in a accident

Most automobile policies require that any adult who lives in a household must be listed on the policy (and premiums paid) because it is to easy for them, being the same household, to use the car and want coverage without paying for it. In order to select the best strategy for defending the lawsuit, an attorney would have to review the pleadings that came with the summons. Based on what you noted, it would seem that the driver that hit your son from behind might have been at fault.
