It would seem that the first priority is to get a new lawyer. If you recover for the medical bills there will be no deduction so that would not seem to be a priority. Keep in mind that there is a two year statute of limitations so if necessary a law suit must be filed before then if you are to collect anything. If the damage to the car is minimal the insurance company will have testimony available that the accident could not have caused the serious injuries you had.
