How much should I ask for pain and suffering?

Answered 10 years and 6 months ago by Mr. Robert C. Slim (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
What you are asking is "How much is my personal injury case worth?"  That depends on so many factors, some of which are tangible and calculable, while other factors are intangible and theoretical.  You have to consider the seriousness of the accident, the injuries, the amount of your medical bills, the jurisdiction of your case, whether you have an attorney or not, the length of your treatment, and so on....... Mother in law liability.

Answered 10 years and 8 months ago by Mr. Robert C. Slim (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
An owner of a vehicle may be liable for a car accident if they lend their vehicle to someone who they know, or have reason to know, is either incapable, incompetent, or unlicensed to drive.  This is called "negligent entrustment."  But this only applies if you own the vehicle.

You may have lost your rights if it is over two years.  There are some ways to extend the statute of limitations in a personal injury case, but there are no extensions allowed just because you are still treating for your injuries.  If the deadline has passed, you may have even lost your opportunity to get the $100,000 that was previosuly offered. You can call an attorney and go over your status, but I do not have a good feeling about your situation.... Read More

can i sue if a drunk driver ran into the back of my car and i had to go to the hospital?

Answered 11 years and 10 months ago by Mr. Richard Keith Oliver (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You'll want to contact a Personal Injury attorney. Those of us that handle these type cases would charge what is called a "contingency fee." That means the lawyer only gets paid if you get paid. With respect to the wreck, whether anyone will take your case depends on whether the person that hit you had car insurance. If so, yes, you can sue. If not, you can still sue, but there will likely be no money to go after. ... Read More

being charged with leaving the scene of an accident and the police want me to give a written statement

Answered 11 years and 10 months ago by Mr. Richard Keith Oliver (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You should "take the nickel." In other words, hire an attorney and hide behind the 5th Amendment. If the cops have enough evidence to charge you, they will. If they don't, all you will do by speaking to them is give it to them. You don't have to incriminate yourself. So...don't.

You can still file if necessary. If you were not hurt in the accident you may not need a lawyer, just file the claim. If you gave notice to your insurance carrier you will have coverage for the property damage even if you were at fault (if you had full coverage). If there were injuries, call for a consultation if you are in the north Texas area.... Read More

Did my steal most of my settlement? Can I get justices or myself?

Answered 11 years and 11 months ago by attorney Mr. Kenneth G. Wincorn   |   1 Answer   |  Legal Topics: Car Accident
Most contracts for legal services are based on the lawyer getting 1/3 of the settlement if no trial. It is usual for the medical providers to get somewhere in the neighborhood of 1/3 and the client to get the balance. Other factors can influence the amount the client gets such as out of pocket expenses, expert fees and other expenses. Look at the contract you signed with the attorney to see what they are entitled to. An ethical attorney will charge no more than was agreed to in the contract.... Read More

do I have a case?

Answered 11 years and 11 months ago by attorney Mr. Kenneth G. Wincorn   |   1 Answer   |  Legal Topics: Car Accident
When I have a case like this, I send a demand letter to the other party requesting insurance information and threaten a law suit if there is not a response within a reasonable time (usually 7 days). Then it is just like any other injury case where we work with the insurance company to get paid for the injuries and damage. If there is no insurance we make a claim under your policy for uninsured motorist.... Read More

how do i hire another attorney?

Answered 11 years and 11 months ago by attorney Mr. Kenneth G. Wincorn   |   1 Answer   |  Legal Topics: Car Accident
You do not have to approve a settlement amount so if it is too low. Discuss it with your attorney and you can go to trial If necessary. If letters of protection were issued by your attorney or liens were filed these amounts are paid first before settlement. The law firm has a lien for the amount agreed in the contract. ... Read More

Demand the police report or better yet have your attorney demand it if you are hurt
This is a typical situation. Often the pain does not seem bad at first so no claim for damages an no police report. You still have a valid claim. If the injuries are real and painful you should follow up with an attorney. Call if needed.

Is this a fair settlement offer?

Answered 11 years and 11 months ago by Marion Cain (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
This is a case that really needed an Attorney from the very beginning. The statute of limitations is two years so perhaps a good PI attorney can still straigten this out!! Make an appointment with one in your town as soon as possible.

You may get satisfaction by calling the Texas insurance commission and submitting a complaint. You could also go to small claims court (also called Justice of the Peace Court) This court has jurisdiction up to $10,000.  It runs much like the Judge Judy TV program and you do not need an attorney to represent you.  The clerks will help you fill out a short Petition (claim form) and the constable will serve the petition.  You will be in court very quickly. Many Texas cities have several of these courts so choose the one nearest to where you live or where the dispute arose ( probably the body shop). The clerks will tell you if you are in the wrong court and help you figure out the correct court.... Read More

Expelled from school for absences due to injuries from car accident can I get my tuition back ?

Answered 12 years ago by Marion Cain (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
The issue regarding tuition will turn on the rules in the school handbook.  Your school expulsion and loss of tuition is part of your damages.  Since you were rear ended - which in Texas has a presumption that the other party is liable, I assume you have a lawyer.  Discuss this in detail with that lawyer and provide him/her with the records to prove your expulsion and loss of tuition.... My son side-swiped two cars, damaged them and his own, panic and lef the scene.

Answered 12 years and a month ago by Mr. Richard Keith Oliver (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
If no one was injured in the two vehicles, he will likely be charged for failing to stop and give information. It's a misdemeanor, Class B, I believe. The punishment range is up to 6 months in jail and/or a $2,000 fine. Get him an attorney so he can (hopefully) keep the charge from impacting your son's permanent criminal record.  ... Read More

is there anything I coud do?

Answered 12 years and a month ago by attorney Mr. Kenneth G. Wincorn   |   1 Answer   |  Legal Topics: Car Accident
You asked for a cheap job and you got a cheap terrible job. If you know the person you can sue him in Justice Court. It is probably not worth it but if you want to try to give him a lesson go ahead. You lost $250 plus what it costs to do the repairs to correct the shoddy work so sue him for that amount. It is not enough loss to consider hiring an attorney but you can sue by yourself. Next time, remember that if it is too good to be true it is too good to be true!... Read More

You have an above average chance of winning. The problem is recovering the damages. You will probably need to include his grandmother in law suit as an additional defendant and claim that she negligently entrusted the vehicle to her grandson.
