I was hit by a 15 year old driver who had a permit. Car totaled. Nagging injuries for several weeks. What would be reasonable settlement?

In this site, I try to answer questions and give general advise about the law. Since each case is fact specific, I avoid giving answers to specific cases because there might be facts that are not listed that might affect the outcome. Therefore, I can not tell you how much is a "reasonable settlement" in your case. I would suggest that you might want to speak with an attorney in your area to seek an answer to your question. Another alternative, is to Google your question. I did that and found some websites that might be of assistance to you.... Read More

Can I share in a settlement legally in Florida for being a witness?

Why on earth would you even think that would be proper? Witness is not a career choice or employment opportunity, its a public duty.

Its literally impossible that a car warranty repair issue would cause you to lose your job and claiming so makes you look like you are just working an angle. There are literally DOZENS of things that could have been done for transportation starting with Uber, borrowing a car,  or buses. That YOU allowed a vehicle to sit at a dealership - likely because you could not afford or refused to pay for repairs - is inherently ridiculous, and that is likely why it was sold to pay a mechanics lein for storage. Its simply not credible that they refused to provide you a repair estimate FOR A YEAR as thats what they do for a living. What you should have done is retained a lawyer when they refused the warranty repairs, if it was a warranty item and they were wrong OR if you know they were right, removed the car to a shop that would have addressed the repair cost. NOT a year later. ... Read More

The failing in your position is a classic one - they other driver I didnt see and collided with must have been speeding - which begs the queston of how could you possibly say such thing with a straight face when YOU were changing lanes UNLESS you admit you saw the other driver and pulled in front of them anyway. In your situation, if you have the ID for witnesses saying the bike rider was swooping in and out of traffic at high speed, provide this information to your insurance defense lawyer and they will address that. ... Is it possible for me to fight this case?

Answered 7 years and 2 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
Hiring an attorney and then trying to get a satellite of the area where the accident happened (if such even exists) would be expensive, probably more so then paying to have the other cars fixed.

The statute of limitations to sue another party for an automobile accident is typically 2 years, so if March 2018 was one year, you should still have several weeks to timely file suit.

Injury cases are not evaluated that way - the involve assessments based not only on liability and damages but collectability. You can "go for" anything you like but  if you cant collect it efficently you have to weigh the expense and risk. You also have a LOT of pitfalls that could cause you to get NO MONEY from the course you referenced. You really need to retain a lawyer to help you work through this, ... Read More

No way to tell without reviewing your file and medical records. Bottom line is many insurers will not pay large settlement values on PI machine doctors claiming you need surgery because they know they win those cases most times at trial as most times its a puffed up bluff. Its a tough call to get surgery as then the fight shifts to trying to reduce the bills to get you value when there is a coverage limit or risk a trial to see if you can collect on a judgement over the limits if you get one. You have a lawyer you need to follw thier advice OR fire them and find a lawyer that you trust to advise you. ... Read More

Most automobile policies require that any adult who lives in a household must be listed on the policy (and premiums paid) because it is to easy for them, being the same household, to use the car and want coverage without paying for it. Look at your automobile policy which governs what is covered and what is not.... Read More

There is a national recall campaign and class action against airbag manufacturers. You might Google this and make a claim through them for damages. Good luck.... Read More
