Who want to be the lucky one to get it, BUT only on a percentage basis!?" So you failed on your first attempt, hired a lawyer, claim he did nothing "after the fact" and now presumably dont want to pay him? This would have been more credible if you fired him during the process because he was not responsive or not "doing his job". Raising these issues after the fact will likely be percived as simply being opportunistic and greedy unless there is undeniable evidence that the lawyer and his office provided absolutely NOTHING that aided result.
