My son was verbally and emotionally degraded by his teacher. What can I do?

Answered 13 years and 10 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Business
Speak with the teacher regarding what your son did to deserve this. "Degrading" someone isn't against the law.

Do I have rights to see my grandma in the hospital if her boyfriend is making a scene

Answered 13 years and 10 months ago by Mr. Richard Alan Alsobrook (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Business
Your Grandmother's boyfriend should have no say in whether the hospital admits you to see your Grandmother.  It is the hospital's decision, and your Grandmother's decision as to whom she chooses to see. This is not intended to be legal advice, and is general in its nature. No attorney-client relationship exists or is formed by this information. Furthermore, this does not represent the views or opinions of LexisNexis or its affiliated companies. ... Read More

New York law does not allow parties to contract a common-law marriage. However, if you validly contracted a common-law marriage elsewhere, either before or during your New York residency, you may have a valid common-law marriage. You do not provide enough facts from which it can be determined whether you contracted a common-law marriage elsewhere. The facts that you were born in another state, or had multiple children with your deceased partner, or were named as a beneficiary under a life insurance or pension, are all insufficient to constitute a "marriage." For you to have been "married" under the laws of a state other than New York, you must, most importantly, have held yourselves out as being married. Those facts are not evident from your inquiry.... Can I sue this hospital

Answered 13 years and 11 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Business
Anyone can sue anyone for anything. The more important question is whether you will be able to find an attorney to represent you in a lawsuit against hospital on a contingent-fee basis. Generally speaking, a personal injury attorney will be looking to see if you have suffered substantial injury -- that has a substantial monetary value -- as a result of negilgence that is relatively easily proven. Your facts do not make the hospital's liability for your diabetes and premature baby clear. You should discuss the situation with an attorney.... Read More

Should I bring a lawsuit against bank where one of the customer exposed himself to me?

Answered 13 years and 11 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Business
Probably not, for two reasons: first, it was not reasonably foreseeable by the bank that one of its customers would misconduct himself (thereby rending the bank not liable for the customer's misconduct); and second, unless you can prove that you have suffered some kind of legally recognized injury, you probably could not recover any meaningful damages.... Unless you have an employment contract or similar arrangement, you are an "at will" employee whose employment may be terminated at any time for any reason or no reason at all. It doesn't sound as if the "retaliation" about which you complain is founded on a prohibited basis (such as your exercise of legal rights or membership in a protected minority group).... Read More

Answered 13 years and 11 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Business
You don't provide enough information to respond to your inquiry. In order to respond, you would need to provide your name, their name, whether either name has been registered as a trademark, the nature of your respective businesses, and how close they are geographically and competitively.

Racial discrimination

Answered 13 years and 11 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Business
Unfortunately, the legal system in the United States does not provide a remedy for every insult or injustice. Because the statements that were made to you did not cause you any meaningful harm (in a financial sense), the opportunity for you to sue and obtain a recovery is not good. Moreover, it is not clear that you were discriminated against in a legally recognized way, since you weren't denied employment or excluded from any financial benefits on the basis of your membership in a protected group. I'm sorry you were treated this way -- it was awful and inexcusable. You are already received an apology. I don't think you should count on much more from the legal system.... Read More

Can my landlord servd notice to quit during restraining order?

Answered 13 years and 11 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Business
Probably so. The behavior that is governed by the restraining order is different from his ordinary conduct in the course of your landlord-tenant relationship. The mere delivery to you of a notice to quit under your lease is not the kind of conduct that the restraining order is designed to preclude.... Read More

What can I do if the College attorney and the College dean fail to resolve my complaint?

Answered 13 years and 11 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Business
You will need to review the DOE's determination with an attorney. It appears that whatever action the school took against you that was "discriminatory" took place in 2009, not 2011, and may now be subject to applicable statutes of limitation. See an attorney immediately to determine if you have a viable claim.... Read More

Assuming your housing arrangements are voluntary and compliance with the rules of the institution is required for all residents, I can think of no legal reason why those rules should not be applied on a non-discriminatory basis to you. If you are involuntarily committed and are being denied needed medication on the schedule prescribed by your physician, that might be another story.... Read More

It is not clear that you can or should do anything. Normally, when one employee speaks to another employee of the same employer, there is no "communication" for defamation-law purposes because both the speaker and listener are deemed to be the employer. What would happen if you did nothing and just forgot about it?... Read More
