Youch. You should have contacted a lawyer about $75,000.00 ago. This all revolves around what your agreement was and what the issues are for re-payment (i.e. why) and whether or not he has the money to give. You need to hire a lawyer ASAP to address this.

Will I be able to recover money lost from a fraud/scam?

Answered 11 years and 11 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Not likely. You should always know that money for nothing always has a catch. You can report to Attorney General but dont hold your breath about a refund and you will still likely owe the bank because you DIDN'T wait till check cleared, you waited until you got an account credit.

Can a dealer sell me an "as is" car under deception

Save the ad. If it was a dealer sale, you may have a case under Fla. Stat. Chap. 501. Typically, you will need to retain an attorney to handle the issue and seek reinbursement of the fees should you prevail.

Unfortunately, this all revolves around whether a dealer was involved as it would involve Fla. Stat.501. If it was a private sale, your case is against the individual and will be MUCH harder to collect.

This is a very complicated situation that should be reviewed by a lawyer you hire to address the issue. While you might sign the title to him, there may equally be a likelihood that he obtain financing in your name, which he cannot simply "get you out of". I have litigated a number of lawsuits against storage companies including Extra Space Storage and Storage Etc.  The first step would be to determine when this happened as there are legal deadlines to sue.  The second is to determine whether you have to arbitrate or can go to court.  The third is to review your tenant file and particularly the legal notices that were supposed to be mailed to you.  All of this can be done for free and if you turns out you have a case, then normally representation would be on a contingency.  The Self-Service Storage Facility Act governs the sale of your stored property and has many technical requirement with which I am familiar.... Can I sue my contractor?

Answered 12 years and a month ago by Lawrence M A Centanni (Unclaimed Profile)   |   2 Answers
Based upon the limited facts presented, yes, you do have a case. You can file a lawsuit for consumer fraud (where you are entitled to triple damages, attorney fees), breach of contract, breach of good faith and fair dealing, promissory estoppel, recission, and the list goes on.  However, and more importantly, you have a project that needs to be completed. You have to find someone to complete this job.  In addition, although litigation is an option, so is amicably resolving this matter because who wants to spend money to litigate (good money after bad money).  Please contact me to discuss this matter further.    ...
