YOU wont be able to file a lawsuit like this competently, so I would advise against even trying. This is supported by the poor decision making leading to being in this position in the first place. If you intend to actually file such a lawsuit, you will likely need to retain an attorney, typically at a pre-paid retainer/hourly rate as the lawsuit desribe is likely very complicated. In the future, you shoudl investigate the numerous other means of making such purchases in a manner that provides more protection for your transactions, and if this was a commercial event, retaining a proper corporate lawyer to help you establish better policies in the future.... Many lawyers wont take them on contingent fee and the 5k of damages might not be worth the expense especially if you did not buy separate insurance.
