I believe you have a possible criminal case. As far as consumer fraud, it depends whether you actually suffered damages. If you weren't charged because you proved that the purchase was by your ex, then I don't know whether it would be worth pursuing as a civil case, because you may not have suffered economic losses (damages).... Yes, you might have a claim if the realtor was aware of the condition and aware of your health concerns regarding facts. So you might need to discuss with an attorney an action to rescind the contract or claim other damages.

The only consumer fraud here is on your end. You simply cannot contract with people to buy cars, take possessions of them, then claim to "go window shopping" buy another car, and then play each off the the other for a better deal atfter the fact. You are probably going to get stuck with 2 cars and 2 loans or sued over one or the other ot both. There is no "cancel the contract" after its signed prospect. NOw you will unfortunately need to spend the money you though you were saving on legal fees to hire a lawyer to sort this all out. ... Read More

I am not sure exactly what the question is. If there is a hearing already scheduled based upon a motion or petition that was filed by a party, you have to file papers at least 16 days before the hearing date to give the other party time to answer (28 days if it is a motion for summary judgment). Reply briefs need to be filed at least 8 days before the hearing date. However, if you are talking about a trial, then there should be a pre-trial conference scheduled (at least in Law Division, these do not apply in Special Civil) at which time the parties list their trial exhibits and have them exchanged with the other side or a date is scheduled at that time at which all trial exhibits should be presented. So this answer depends upon the type of hearing you are talking about as well as which court this is in. ... Read More

You can check the deed as it is registered with the county. You can do this yourself but it may be easier to have a title company do the title search. You will then have a written record of how the title to the house was registered. Ed Dimon, Esq.

Once can't misrepresent what one doesnot know so if the car fax was clean you'd have to prove some direct knowledge and also your direct questioning to even start with such a claim. You may however have a warranty case depending on the terms of the warranty. You sould have a lawyer review the warranty to see whether the damages can be fixed under that provision. ... Read More

First, no, a lease intention is the opposite, as if you were buying the bike you would have bought it and financed it. Second, that the bike gets stolen is YOUR problem not the lease company's or the dealers, you still owe on the lease and should have had insurance to cover the loss. Finally, not sure what is going on with the other person claiming its thier bike as there may be something shady going on there from several angles that you will need to sort out. ... Read More
