In 99% of those cases - they will prpoduce records showing that they sent multiple letters and notices telling you to get your car or they will deem it abandoned or sell it off under a mechanics lein. Generally  - just because you have a dispute with the manufacturer - you are not enitled to store your broken vehicle at a dealership for free and without thier agreement otherwise. Its simply common sense any more that if you have ANYONE perform repairs of any type on your computer that YOU are responsible for making and keeping a data back up, precisely for the this reason. Unless you are willing to spend a lot more money than the case is worth "to make a point", I don't see a viable claim here. There are no real damages, and any issue with the restaurant should easily be cleared up by getting the bank to confirm it was thier fault and to transmit the monies owed to the restaurant owner. Bear in mind - if you sue the bank over such an issue - its also likely they will ban you from future transactions as a customer and cancel your account. The problem with such cases is those "scammers" are usually dirtbags or junkies that spend the money as fast as they scam it from thier victims, so expectations of "getting money back" are slim. If the eviction already occurred this would be a problem. The time to address allegations of HUD violations or an unlawful eviction is BEFORE the eviction takes place and hiring a lawyer from the beginning. What is clear, however, is that if the repair cost is $500.00 it is not likely productive to retain a lawyer to intervene as it will likely cost more than the amount in dispute. This does NOT sound like a fraud case. Fraudsters rarely hire lawyers and file lawsuits and go to court for obvious reasons. This sounds like there is something else going on and as such you will likely need to retain a lawyer to address the lawsuit immediately.

That stated, if he was not on the title, this shoudl be reported to law enforcement where he should be arrested for theft. The bigger issue is why would you have a car towed to a dealer for maintenance crammed with all that stuff in the first place? There is much more to this than related and that may impact y our ability to retain a lawyer to pursue this issue, starting with how the EX knew where the vehicle was to pick it up to start start with.
