This is a clearly histrionic explanation as had you legitimately feared for your life you would have sceamed for help, dialed 911 or simething along those lines. If being called a "smart ass" is as you described the basis for such fear and reaction, this likely entails a need for evaluation by a psychologist or psychiatrist as there is clearly a reaction to the events described that suggests some anxiety disorder or other circumstance may be involved. This is not intended to be critical of you but simply an objective opinion about your situation as described. In the mean time, take your business elsewhre and dont shop at Walmart if they treated you poorly. ... Read More

We handle such cases - the issue will revolve around whether its on a contingent fee, hourly rate/retainer or some blended fee structure. This will be determined on what fault T-Mobile had in the porting and the nature of the ID theft issues, especially in regard to the life threat issues, which suggest an "inside job" so to speak. You can call our office at 1-800-922-6442 for a free telephone consult. ... Read More

No way to tell for sure- but the answer is simple - walk away from the deal as its clearly shady.

You will have to hire a lawyer in your area to walk you through this. Not sure why this is being pursued 9 years later wth apparently no records.

The problem is that business people arenot expected to make personal decisions or special considerations for others. That is the responsibility fo freinds and family. If your Uncle is that disabled that he cannot make proper decisons then he needs to get to a guardianship lawyer and have a guardian appointed. That aside this will be a difficult as you are comng in after the fact, so your first issue is to presumably cancel the coverage. THEN you can retain a lawyer for your Uncle to review the situation and see whether there was some impropriety that occurred as its impossible to tell what you are basing "billed as an accident policy" and then called a "rebate program" as neither makes any sense in a vacuum, suggesting that this is all likely incorrect also. ... No real damages and the worst possible defendant for such claims dictate that this is a no starter for a proper injury claim. You can try to see what you can get from them - but most competent lawyers would not pursue such a claim on a contingent fee.

My extended warranty company will not pay for my claim

Answered 8 years and a month ago by attorney Mark Tischhauser, Esq.   |   1 Answer
"Fair" has nothing to do with contract obligations, as "fair"needs to be addresed BEFORE you sign an agreement or buy a product. You will need to retain a lawyer, probably at some initial expense, to review your warranty agreement and the situation, and probably file suit if the insurer won't abide by the agreement. By example, not changing the timing belt would have little to do with replacing a covered window motor BUT could be serious and legitimate issue if there was engine damage caused by a bad timing belt or the engine being out of timing. This typically revolves around the details of the warranty agreement. ... Read More

Little guys don't win when they make poor legal and finaincial decisions. While its laudable that she spends her money on others, that does not get her credit for her own debts or obligations. Not sure what the dealer is expected to do as Wells Fargo is the lender and they have control over the loan. If she is seriously in debt she may want to consider bankruptcy. ... Read More

If you can show the bank employee in fact stole the SSN and ID thefted you, there may be some liability on bank. Its a very difficult case and not likely one lawyers will take on a contingent fee. Hopefully the employee was charged and convicted, as if this is just a suspicion it woud be an even more difficult and expensive case. ... Read More

This is either a lemon law, mag-moss warranty, or a bit of both issue slapped on top of some other damage claim problem. You need to hire a lawyer to start sorting this out, but generally you can't have a vehicle totalled by a hurricane and then expect a collateral swap/replacement vehicle without addressing the damages to your vehicle. There may be ways around this but it will be complicated and probably confrotnational in resolution. ... Read More

please define "lifetime warranty"

Answered 8 years and 3 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
First, this is a commerical issue and as such you cannot possibly use internet blurbs as a substitute for actually hiring legal counsel or corporate counsel. Second, such things are defined by the terms of the "warranty" itself. If a competitors marketing is at issue you may need to consider some means of taking them to task though this may mean spending money on legal fees to address such an issue. ... Read More

Not unless you want to pay legal fees up front to pursue such an issue. There are no damages described so its not worth much financially.

Can something be done?

No. If you miss your flight for what ever reason it is what it is. While the manager may have been rude, your remedy is to complain to customer service.

Do they still have to fix our tv?

Answered 8 years and 4 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
The problem here is that the expense of actually resolving this issue is likely going to be moe than the repair cost of the TV. Not sure how this account got sent to Aarons unless there was some sort of buy out, but in theory one or the other may be obligated to fix the TV.

Can anything be done?

Answered 8 years and 4 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
The solution here is that you need to either learn how to porperly manage a checking account, get someone to help you who can or simply stop using one as its clear that you are mishandling it by constantly being over drawn. Otherwise its simply not feasible to fight over $68.00 when you keep enagaging in the same conduct. ... Read More
