Unfortunately, you blew the lemon law period. Under a normal warranty issue, you can sue for reapirs etc, BUT most no one will take an indisrciminate "its doesnt run right" case on a conitngent fee, so you will end up payong for alawyer out of pocket in most instances.

Can I still be sued if I have no funds or employment?

ZERO chance that the case gets dismissed because you dont pay. Thats why the lawsuit was filed. A judgment is collectable for 20+ years

This all depends on the complaince with Fla. Stat. 828 and whether there was a waiver or disclosure of H/C defects and wheher you have a certificate from a licensed Vet.  Sounds like they claim the parasite issue didn't render the dog unsellable and there is an H/C waiver and you were outside the time frame. That said, if you are buying a purebred dog, and especially a bulldog, you needto be extra diligent before purchase as they are notorious for H/C issues along with skin problems. You may want to retain a lawyer to send a formal demand etter and see if that changes thier mind, though you will likely have to pay out of pocket for the letter. ... Read More

You can report this to law enforcement and see if they can do something for you. If this was an actual scammer you will likely spend more than you gave to them trying to track them down and sue them. You need to protect yourself up front on such issues not rely on trying get your money back after the fact. ... Read More

I bought two wrong gift card...(ol navy ).

Answered 5 years and 5 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Sorry - but no one is going to believe you accidently bought 2 $400.00 gift cards for the wrong store. Especially because the gift cards likely say OLD NAVY on them. You might see if OLD NAVY offer gift cards and possibly use the credit to buy the "correct" cards. Bear in mind that gift cards area huge source of criminal activity like money laundering so that may add to the difficulties. ... Read More

Unfortunately, since you didn't pay attention to this several times over, if they can't get it fied for you on the free, then you will likely have to spendmoney on a lawyer, and that may entail several thousand dollars to file suit and have a court address this.

I have an issue with arrons rent to own

Answered 5 years and 7 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Ok, probably a good bet that the item isn't very good and since its RTO, not a purchase, bring it back and cancel the contract. You wll still need to pay for the time you had it. Otherwise, if its a cheap repair or you have too much invested in it to walk away,  have it fixed and carry on using it. Irs rarelly productive to spend money on legal fees to address such an issue unless the item is very expensive. ... Read More

Its unlikely that the amount at issue is worth a law suit over so the options are limited. Most places are providing credits or extended contracts and not refunds. Bear in mind you are expecting people who have not had actual income for 4 months to refund you and others with money they likely don't have so there is some level of practicality you will have to contend with.... The problem with such a case, is that it won't be viewed as credible by the pizza place beyond nuisance value as there are no real injuries. If your son is claiming a dental injury, the fact that he had TWO emergency dental issues in the past month or so will also be a huge factor in that consideration. Especially if he has no dental insurance as the will claim this is bogus shakedown to pay for other dental bills or to address pre-exisitng bad dental conditions. He need to make a claim with the local franchise and likely see dentist if there is a claim of tooth damage, and then go from there. IF he can find an injury lawyer willing to take the case on, all the better. ... Read More

This is simply an issue of your willingness to spend money on one lawyer to dispute fees charged by another lawyer hoping that you get a better value as opposed to simply adding more fees to the pile. The fact that one lawyer charged more or less than another is not a standard as here a many variables to be considered. Any lawyer that has experience in legal fee hearings etc. will suffice as long as you are willing to pay accordingly as these are NOT contingent fee cases. That stated, you need to be more attentive in the fiuture about the expenses as any dispite about the amount, if excessive, should have been addressed as the bills accrued not at the end, when the payment comes due. ... No idea what steps are needed absent a full review of what you agreed to in writing and what was represented and not delivered. You will likely need to retain a lawyer at some expense to rewiew your contracts and go from there.

Not likely. You made the deal so thats the deal. If you default on the down payment payments, you will likely end up with a reposesion on your record and possibly a lawsuit for whats called a deficiceny balance.

"I immediately start crying and shaking sweating" sorry but histrionics is NOT compensible in a legal case, only actual injuries are. Thankfully there were no injuries, but equally the claim value is weak assuming you can establish liability.  You need to notify Walgreens and see what they say about the staple. Generally such cases have little value when they involve household items of things not expected to be found in the food that occur with no credible witnesses. ... Read More

What type of lawyer do I need??

Answered 6 years and 11 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Likely a consumer lawyer or civil litigation lawyer. Plan on paying a retainer and legal fees in advance under the facts provided as this is not likely a "contingent" fee case.

You need to find out what the $980.00 is for specifically. If its clear you dont ow it you might have a collections abuse case. If you do or its debatable. then you have a contract/landlord tenant case and it may be more efficient to pay the money and clear the credit but you can sue to dispute claim in an effort to have them remove it as part of a settlement. ...
