Unless this is a car you bought in 1997, you bought the car with the injury you described already having occured. As such, this is hardliy a compelling reason for defaulting on the loan. Unless you can show the body shop destroyed the engine thet are not liable. There is nothing a body shop would usually do that affects the engine so unless it was a newer car with properly maintained engine this may just be coincidence.

"Its not fair" and "I wanna cry" are not legal responses to the issue. If you cancelled the line and didn't pay attention to realize they did not andpaid the bills for several months, that is your responsibility equally, especially since you dont remember the day you called. You may want to check your phone bill as presumably this will show up in your call log. Chap. 83/715. if they failed to compmy with the notice provisions and dispose of the property properly, they may owe you damages for the losses you can prove. This sounds like some stipulation from a lawsuit with "being of record". That stated, the loan agreement is the deal, anything else other than a written change to the agreement is a courtesy. If you can't pay for the car and they wont budge, they will likely repossess the car.
