What can I do to stop my wife from filing false claims and moving accounts?

Answered 9 years and 11 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Divorce
I don't what you mean by filing false claims, unless you mean making false police reports. Not much to do about that. If you file a divorce, you can ask the court to freeze all of your bank accounts.

I don't know what you mean by "complain on me and my family about our case". She can gripe about whatever she wants , as we have freedom of speech in this country. If you are asking about her rights if she files a divorce action against you (not your family), you need to rewrite the question with more information in it, or better yet, talk to a family law attorney in your community about the situation.... I have never seen a judge make a spouse go through marital counseling. I doubt this would work.

In the US, a judge will decide who has custody of the kids. Neither of you can just keep them of your own volition if a divorce is filed.

If I file for divorce, can I make her pay for the car?

Answered 10 years and 2 months ago by Jonathan Edward Shimberg (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Divorce
Yes it does matter. It is her care unless and until you get a court order saying otherwise. You have no right to the car until a case is filed. At that point it becomes marital property. You then need a court order giving you the right to possess the car. Unless you take those steps you have to turn over the car to her.... Read More

Is a divorce final as soon as the stay is lifted?

Answered 10 years and 8 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Divorce
I recently answered a question just like this. Either of you can ask the court to set the case fort a final hearing at any time. A "lifting of a 90 day stay", whatever that means in this context, will NOT automatically get you divorced. Indiana statutes have a 60 day waiting period after filing, but no 90 day period is involved at any stage.... Read More

How do I legally get my spouse out of my house?

File for divorce. Ask the court to make a decision on who should have sole possession pending the completion of the divorce.
File for divorce. Ask the court to make a decision on who should have sole possession pending the completion of the divorce.
This question does not make any sense in terms of Indiana law. To cut through all that, if you want to finalize the divorce, you can ask the judge to set it for final hearing at any time. You should go ahead and do it, not wait for her or ask that she do it. The judge's response will tell you what you need to know in terms of when this will happen.... Read More

Am I entitled to any of the house if my husband had the house before we were married?

Answered 10 years and 9 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   17 Answers   |  Legal Topics: Divorce
First things first: consult an experienced matrimonial lawyer. That said, you are likely entitled at the least to one-half the increase in value of the real estate during the time you were married. Some judges, in a divorce after a long marriage (19 years is long), may divide up the total equity in a house under these circumstances, but don't count on it.... Read More

After our divorce, as the noncustodial parent, do I have to provide my address to my ex?

Both parents have the right to know where the other one lives as a matter of common sense, and under Indiana law.
