If I am trying to get my felonies expunged and I receive a misdemeanor will I have to start the process all over?

Answered 12 years and 8 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
In Missouri, if the felony you want to get expunged is one of the felonies that qualify for expungement, you have to wait 20 years from the date of conviction before you can file a petition for expungement. During that 20 years, you can't have any other misdemeanors or felonies. So, if you received a misdemeanor during that time, you would have to start all over with the 20-year time period.... If I have four felony convictions, how much would it cost to get records sealed?

Answered 12 years and 8 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
You can't get the felony convictions sealed. There is something called "expungement" of criminal convictions, so perhaps that's what you're referring to. In Missouri, only a few types of felony convictions are eligible for expungement, and only after 20 years of good behavior. You need to consult a criminal defense attorney in the city or county where the convictions were entered and find out if your felonies are on the list of felonies that qualify for expungement.... How can I get a Class D drug Felony dropped to a misdemeanor?

Answered 12 years and 8 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
If he was convicted of felony marijuana possession 14 years ago, then it's too late to try and get the felony reduced to a misdemeanor. The time for that was back when he was first charged with the crime. At that point, his attorney may have been able to negotiate a plea bargain with the prosecutor, but if was convicted, then it's a done deal. Assuming this happened in Missouri - there is no way to seal his record or expunge the conviction from his record.... Read More

Only a few types of felony convictions are eligible for expungement, and only after 20 years of good behavior (no other misdemeanor or felony convictions during that 20-year period). The felonies that are eligible for expungement in Missouri are 1) passing a bad check, 2) fraudulently stopping payment on a check, or 3) fraudulent use of a debit or credit card device. If your felony conviction is one that is eligible, you can file a petition for expungement in court or hire an attorney to handle it for you.... Read More

Will the prosecuting attorney offer me a plea bargin?

Answered 13 years and a month ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
You will have to hire an attorney to represent you to negotiate a plea bargain with the prosecutor. It's not the prosecutor's job to give you a good deal, so if you are not represented by an attorney, the prosecutor will try to get you convicted and sentenced to the highest fine and longest amount of time in jail that he can get. Keep in mind that, at age 17, you are an adult in the eyes of the law. If this is a state violation, then you can ask the judge to appoint a public defender. If it's not a state violation and these charges have been issued by a municipal court, then you won't get public defender. Public defenders only work on state cases.... Read More

The waiting period for a Class B misdemeanor is 4 years, a Class A is five years. Those dates start from the time probation ended. Assuming he is not disqualified on other grounds (for example, too many other convictions), it is possible that he is eligible now for expungement. It is a lengthy process, so you should see an attorney as soon as possible to get started.... Read More
