It does not void the PFA. Be careful not to reply to her contact. If your Mother wants to discontinue the PFA, she can petition the court to make it expire sooner than the 3 years. There is no longer a provision to withdraw a PFA.

How do I joint custody of my two daughters?

Answered 11 years and 9 months ago by John Karl Puskar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
I don't know enough facts about your case. However, you need to start by filing for joint custody in the county where the children live. If you already have a court order in place, you need to file for a modification of custody.

Who is responsible for the dental Bill for my daughter?

Answered 11 years and 11 months ago by John Karl Puskar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
The other student's parents and/or the school. I would talk to the school about having their insurance cover the bill. Otherwise, you will have to file suit against the school and the other student.

Can my fiancee change the locks on the doors to his home without giving me notice to leave

Answered 11 years and 11 months ago by John Karl Puskar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
You are correct. You need to be given a 15-day "Notice to Quit." If you don't leave after the 15 days, he can then bring a suit at the magistrate to have you evicted. He cannot simply throw you out. I would call the police and file a complaint.

What warrants supervised visitations, and who is responsible to transport the children to the agreed upon visitation location?

Answered 12 years ago by Lisa M. Petruzzi (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Whether supervised visits are ordered is very fact-specific in custody cases, depending on factors such as the allegations giving rise to the requesting relief, the age of the child, and any past domestic violence.  Who supervises is also fact-specific; the court has to make a determination as to whether the proposed supervisors will ensure the child(ren)'s safety, even if it is their own family member who they are supervising.  Sometimes family members are appropriate supervisors; other times, it benefits both sides to have a neutral supervisor, such as a court-approved agency, if available.  However, there is a cost involved for these types of supervisors, and the court will need to determine how those costs should be shared.... My boyfriend of 12 years wants to add me to house title. His lawyer refuses to do it.

Answered 12 years and a month ago by John Karl Puskar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
If he really wants his lawyer to add you to the deed and the lawyer refuses to do so, then he needs to find a new lawyer. As it stands, if you separate, you are not entitled to the house. You would, however, be able to sue him to recover the money you have put into the house.

I have a daughter whos dad had left her four years ago does he have the right to see her again

Answered 12 years and 2 months ago by Lisa M. Petruzzi (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Dad still has a right to pursue custody if he chooses to; however, the court must look at the best interest of the child, which is the standard to be used.  While you cannot prevent him from filing a custody petition, a court would evaluate all of the factors to determine whether it was in your daughter's best interest to have custodial periods with Dad.... Answered 12 years and 3 months ago by John Karl Puskar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
It's very possible that the Department of Public Welfare made her file since she is receiving benefits on his behalf. I would defend against the child support claim (should not be hard if he is living with you exclusively) and call the Welfare fraud hotline in your county to report her.

It shouldnt be difficult. You can go on line and find out. The PA Department of Vital Statistics birth and death records. There is one in downtown Pittsburgh and there was one in New Castle. You can call or order on line. They usually require a completed form and a check or money order for, like $10.00. As for SS, call them or go on line. You can get a driver's license application on line or at any PA Department of Motor Vehicles Driver's Center. I think you can get a state photo ID there too. ... Read More

Need help seperating from "significant other"

Answered 12 years and 4 months ago by John Karl Puskar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
It depends on your living situation. If you rent and he is on the lease, ask the landlord to evict him. If he is not on the lease, you have to move to evict him. If you own the house and he doesn't, you must evict him. A lawyer who practices landlord-tenant law is a good resource for this kind of situation. There is no legal process to obtain a "legal separation" in Pennsylvania.... Read More
