Yes. You will have to sue her and won't be able to sue her insurance company. The Insurance companies have had a law passed in Alabama that says you can't name them in a suit like that! Complain to your legislator. As an alternative to suing, you can make a collision claim on your own policy and let your insurance company worry about getting their money back. If they do decide to pursue that avenue (called, "subrogation"), be sure they get you your deductible back as well. Good luck.... Read More

Although you do not say it, it appears you had some sort of injury on the Post Office premises. The details are lacking, which makes it difficult, if not impossible to answer your question. However, I'll give it a shot. If there is a premises liability policy on the property and it has a med pay provision in it, it may pay for your medical bills only. Whether you would be entitled to pain and suffering is dependent on whether there is any liability on the part of the owner or the Post Office. Usually fee agreements authorize the lawyer to sign for you, allowing he or she to endorse checks and get them cleared in the trust account as quickly as possible so you can get your check for the net recovery. There is no law or set rule, but I believe it to be a good practice to provide a copy of the settlement check when the settlement accounting is provided.
