What should I do if suing a mechanic for taking too long to finish the job?

Answered 10 years and 11 months ago by James Eugene Hasser (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You would have to go to Small Claims or District Court, depending on the amount of money sued for. You will probably need another mechanic to look at the car and tell you how much it is going to cost to finish it. You would sue the mechanic for the cost to finish minus the $500 you haven't paid him yet. Consider consulting a lawyer. Good luck.... Read More

Do I have grounds to sue the dealership for the damage done to my car?

Answered 11 years ago by James Eugene Hasser (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Maybe, but it will take a mechanic expert to tell you whether they are liable. More than likely, your dispute will be handled by arbitration. Look at your sales documents and see. Presuming so, you will need to find a lawyer who handles arbitration cases against car dealerships. Good luck.

Will the landlord be responsible to cover ER visit and having tooth fixed?

Answered 11 years and a month ago by James Eugene Hasser (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
I cannot tell for sure who would be liable from your description of the conditions that caused you to slip. I would also need to know what contractual obligations the landlord and you have with regard to removing or guarding or warning against the ice. Generally speaking, though, whoever is in control of the premises would have a duty to warn or guard against any known hidden hazards or to remove the hazard. Hope that helps. Good luck.... Read More

If I rear ended someone and I don't have insurance, what can they do to me?

Answered 11 years and 4 months ago by James Eugene Hasser (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Well, if you are liable and they sue and get a judgment, they can attach your bank accounts, garnish your wages, lien your home and do what creditors do to collect debts. You might want to talk to a lawyer, though. Just because you hit someone from the rear, doesn't necessarily make them liable. It just creates a presumption that they are liable. That presumption can be overcome by other evidence showing they were at fault too. Good luck.... Read More

What is the fine if I hit a parked car left the scene then came back?

Answered 11 years and 5 months ago by James Eugene Hasser (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
I don't know what the fine is, but if you were ticketed, look on the ticket itself. It usually has the fine spelled out on it. If you were not ticketed, you don't have a criminal problem. Let your girlfriend's insurance handle the civil claim. Good luck.

Did my employer violated my HIPPA rights by attending my doctorsโ€™ appointments when I was assigned a workers compensation nurse?

Answered 11 years and 5 months ago by James Eugene Hasser (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You need to talk with your lawyer about that. I typically do not allow nurses or employers or adjusters in the examining room during exams. I also make the nurses agree not to testify against my client before allowing them to provide services. Alabama comp law allows the employer to have access to your medical care information. However, I do not know how that affects your HIPPA rights, as those are Federal laws. I do know that you have your patient/physician privilege to privacy, though, and you can insist on exams being private. The Dr. has to honor that. Discuss strategies with your lawyer. Good luck.... What can we legally do if the mail wonโ€™t come to the county approved road that we are in?

Answered 11 years and 6 months ago by James Eugene Hasser (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Quite frankly, I don't know and would have to do extensive research to give you an answer. One of my clients is a carrier and he thinks that there probably is not much you can do, unless you are disabled, in which case, you may be able to get them to deliver to your door. I would suggest you get back with the Post Master and/or carrier and ask them what, if anything, can be done. The answer probably lies in Post Office rules and regulations, of which he, or they should be familiar. Good luck.... Read More
