Do I have a fighting chance in court even if its been a year?

Your daugher absolutely has a case. Most people do not seek to litigate immediately after an event like this, it is only after they conclude that there is permanent harm that the consider consulting an attorney. You have plenty of time to investigate and prosecute a claim. The statute of limitations for a minor does not start tolling until 2 years from the eighteenth birthday.  Contact a reputable personal injury attorney who will (a) put the salon on notice a of a potential claim and obtain insurance information, (b) obtain all of the pertinent medical records, (c) attempt to settle the case out of court if that is possible, and (d) litigate if settlement is not possible.  All personal injury attorneys (including my office) work on a contingency basis and provide free consultations.  Click here and here for more information about me. Whether you have a viable claim depends on the outcome of the choking incident. If she was essentially unharmed, it is probably not a vaible case.  If this did result in significant physical harm, you should contact a local personal injury attorney (one in your state).  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. You can use the "Find a Lawyer" service through this website to research personal injury attorneys. Then, visit each attorney's website and select a firm that has a record of successful verdicts. If you are unable to find a lawyer who meets these qualifications within your state, sometimes you may contact an out of state lawyer who can refer you to a qualified attorney in your state while providing support related to the issues of medicine. Send the letter to your car inusrance carrier and let them deal with the situation.  The issue involved your vehicle, and your car insurance company will address the matter.   Meanwhile, I would advise the Shopright where that person works that she used information from their database for her own purposes.  I am sure that was not permitted and is a violation of your privacy. ... Its really not been that long of a time, although it must seem like it !  Many attorneys deal with dozens of cases at one time, and have many, many documents to handle.  Your releases were probably sent to the insurance company, who will take their time in paying your claim, and then it will come to the attorney.  If you are concerned, call the attorney, ask to speak to the paralegal and ask if there is an anticipated date on which you will receive payment.... can I sue a school

Answered 11 years and 10 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
It really depends on why you fell. If you fell because of a substance you may have a viable case. It is possible (but in my estimate not likely) that you have a design defect case. Finally, note that under the Tort Claims Act, you have to file a Notice of Claim within 90 days of the accident, or your cause of action may be barred, so talk to a lawyer ASAP.  You should contact a local personal injury attorney (one in your state).  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. Answered 11 years and 11 months ago by attorney Diana L. Anderson   |   1 Answer   |  Legal Topics: Personal Injury
If the broken glass was caused by the bar's negligence, then you can make a claim.  However, in your case, it sounds like you broke the glass and caused the accident yourself.  I am not sure what the cause of action against the bar would be.

Your damages are limited to the amount you paid for the sandwich.  You did not eat it, so you were not physically damaged in any way.  The restaurant should have either given you a new sandwich or reimbursed you.  If it is a chain restaurant, I would write directly to the national headquarters and by-pass the local store.  Good luck.... Can i sue a TJMAXX heavy object fell on my head.

Answered 12 years ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
It sounds like you have a claim worth investigating. Obviously, the store should not stock items on shelves in a way that causes injury to their patrons. Its possible that another customer moved the item and created the risk, but the store has an obligation to take reasonable steps to make inspections to make sure that accidents like this do not happen.  You should contact a local personal injury attorney (one in your state).  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. My son was hit and killed by school bus, what kind of lawyer do I need

Answered 12 years and 2 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Personal Injury
I am sorry for your loss. You need a personal injury lawyer, preferably one who has experience litigating cases involving similar types of claims. If you would like to shop around, you can use the "Find a Lawyer" service through this website to research personal injury attorneys. Then, visit each attorney's website and select a firm that has a record of successful verdicts.  Click here and here for more information about me. Finally, if you have already found an attorney, you should recommend that they retain an expert in bus safety. In my opinion, the expert to go to in these kinds of cases is Ned Einstein, of Transportation Alternatives. Click here for information about Ned.  He is a very knowledgable guy, and it helps to work with him right at the outset of a case because he provides important consultation services during the discovery process in a lawsuit.  Please note that by attempting to answer your question, I am not acting as your attorney. Is there legal action that i can take if I was struck by a van while walking my dog in a crosswalk?

Answered 12 years and 3 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You should contact an attorney. First, you have a liability claim against the driver of the van. Second, who is responsible for the bills is contingent on a few facts. If you or a resident relative had auto insurance, their policy would be responsible for payin the bills. If no resident relative has auto insurance, then PLIGA would be responsible for paying the bills. Finally, if the vehicle that struck you was a commercial vehicle, their policy would cover the bills. You cannot take legal action if you "could have been injured".  You can only take legal action if you suffered an injury as a result of the negligence of some one else.  Inducing labor was probably within the normal medical practice.  If you and the infant were both healthy, then there is no way to measure your "pain and suffering".  I understand your claim was that labor was more painful than it should have been, but that is going to be very difficult to measure.  ...
