the man is trespassing and I believe law enforcement should remove him from the premises. However, it sounds like the law enforcement does not wish to get involved because your x was rightfully there to begin with and they read the trespass laws to require wrongful entry. You need to hire a lawyer and treat him as if he was a tenant who has held ove beyond his lease.... Read More

I'm being sued for my ex-husband's debt, even though our divorce decree states I will not be responsible.

Answered 8 years and 8 months ago by Richard Lane Hughes (Unclaimed Profile)   |   1 Answer
It appears that you need to file a motion to hold your husband in contempt for failing to get you free from the loans. That is, unless he has done so and the bank has made a mistake in naming you in thee lawsuit. Either way you must act timely to answer that lawsuit and deny the debt. If you wish to contact me you may call (501) 376-1112 or email hugheslawoffice1@gmail.com... Read More

There are a number of ways. Beyond the obvious (photos, etc.) testimony regarding his admissions; his girlfiend's testimony, etc.  You should understand that fault in a divorce does not impact upon division of property or alimony. Divorce decree

Answered 8 years and 8 months ago by Richard Lane Hughes (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
Your divorce decree would neeed to be reviewed. Typically, those funds are divided at the time of the divorce if the spouse is vested in the retirement account. Railroad and military retirement have certain special rules regarding division. You need an attorney to review the situation. ... Read More

If my child father took my child from Arkansas to Colorado and refuse to bring her back what do I need to do?

Answered 8 years and 8 months ago by Richard Lane Hughes (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
Your friend needs to hire an attorney to file a paternity petition for her and get an emergency hearing to get the child back in this jurisdiction. Then, through the Court visitation and support of the child can be established and enforced.

Do I have a case?

Answered 8 years and 8 months ago by attorney Bruce Robins   |   1 Answer
I don't think you have a case because you suffered no damages.  A car blows a red light and hits your car, damaging it and also causing you a broken arm.  You have an excellent negligence claim.  If in the same circumstances the car just misses you, scaring you to death, you have no damages, and no civil case (the district attorney could theoretically bring a criminal case for reckless driving or the like).... Answered 8 years and 8 months ago by Richard Lane Hughes (Unclaimed Profile)   |   1 Answer
Yes. Hire an attorney, file a petition to probate the estate and ask to be appointed as personal representative of the estate. You can then freeze all assets until there is an accounting and the Court approves division or sale of the property. Richard Hughes (501) 376-1112 hugheslawoffice1@gmail.com ... Read More

Guardianship, how to get it back.

Answered 8 years and 9 months ago by Richard Lane Hughes (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
It sounds like the "Guardianship" you have is simply an agreement between you and Grandmother. A Court has not made findings that are required to obtain or order a legal guardianship. Really, a lawyer needs to review that document and confirm that it was not submitted to a Court for the purpose of establishing legal guardianship of your child. Richard Hughes (501) 376-1112 ... I think that you answered your own question. You need a lawyer representing you. If you cannot afford a lawyer, the Court will appoint one for you. IF you had a permit, you shouldn't have a problem if you were driving at a time and for a reason consistent with your permit. If you got a DWI or were driving at a time and for a reason not allowed by your permit you will be in danger of the permit being revoked. Richard Hughes (501) 376-1112... Read More

exboyfriend trying to get visitation of my unborn baby.

Answered 8 years and 9 months ago by Richard Lane Hughes (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
You probably need to file a paternity case establishing formally that he is the biological father of the child (this can be agreed to). Then a Court will dictate visitation, child support, etc., including ordering him not to harass you. He will get some type of visitation if he acts right but it will be limited initially and controlled. It is very unlikely that he will get custody.... Read More
