Your car is worth what its worth and the insurance carrier is not obligated to pay your loan value if you made a bad financing deal. Your only fight here is over the actual market value of the car, but you will have to prove its worth more if its totalled, as it seems. They only pay lienholder alone when its totalled. ... Always the people liable for the injuries screaming "scam" as if that makes it so. You have insurance and they will address the claims handling and determine if the case is a "scam" or not. That stated, YES, if your son was driving your vehicle and crashed into someone, you are responsible for the damages done as if you were driving the car, under the dangerous instrumentality doctrine. That you don't like that or don't want to pay or the insurance rate hikes from the loss issues, is of no consideration. There a many instances where a person that appears uninjured at the scene develops pain when the adrenaline wears off or has injuries show up later. Its so common its actually addressed  in most hospital discharge papers. ... Read More

So if you are broke and bankrupt, under what fanatsy were you pretending to have the money to pay for $6k worth of damages as opposed 60k or 6 million? That stated, report this to your insurance carrier and give the other person your insurance information and they will handle that initial aspect for you. If she calls the cops and there is some claim of criminality like you were DUI or fled the scene or such, whether true or a lie, you wil simply have to contend with that, since for some odd reason the police weren't called to the scene. ... You don't. Under Florida law the person causing the crash is not responsible for your bad business deals on a car. They only owe market value of the vehicle, plus tax and title costs.

I am being sued by I surance company

Answered 5 years ago by attorney Mark Tischhauser, Esq.   |   2 Answers   |  Legal Topics: Car Accident
This needs to be handled by your liabilty insurer at that time OR if you did not have that type of coverage, then you will need to retain a lawyer out of pocket to defend the lawsuit. Your defense is that the vehicle was "stolen" but you will have to prove there was no negligence on your part like leaving the keys out or such. ... Read More

What type lawyer will handle personal property damage

You can find plenty of lawyers to hire, just none on a contingency fee, as you will have to pay a lawyer an hourly rate up front.

What type of lawyer do I need?

Answered 5 years and a month ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Car Accident
You are not a "witness" - you are a defendant and you know darn well you recall the crash, as you were in it, short of some impairment issues. This sounds like a UM claim and there is an issue here where you are likely to be sued by the other persons insurance company in "subrogation".  You need to hire a civil trial lawyer to address this ASAP. ... Preserve the truck for expert examination. Do not delay. Discuss your injuries and damages with a Personal Injury attorney asap. Do not delay for purpose of investigation and gathering of evidence. In order to pursue a Product Liability case, damages will need to be very significant to balance the cost involved in pursuing this sort of claim. ... Read More

Can I keep my car if the insurance company declared it totaled in Florida?

Answered 5 years and 2 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Car Accident
They are not required to give you "whats wrong with it". Its a mathmatical calculation where the damage collectivelly equals or exceeds 80% of FMV. That you fixed the car may not change things because it may well be reported to DMV for a branded title, meaning you can't sell it and likel won't be able to register or tag it unless DMV certifies it for a rebuilt title. Why they paid nothing is a separate issue that can't be explained as they should have paid for towing, storage andsome repairs generally. ... Read More

Yes under the dangerous instrumentality doctrine.

Turn this over to your insurer. If your car was legitimately stolen, you are not generally liable for the damages to other peoples property.

Auto accident BI settlement release

Answered 5 years and 2 months ago by attorney Loren L. Gold   |   1 Answer   |  Legal Topics: Car Accident
There are potentially other issues of concern if your case case has value in excess of those policy limits where there may be other potential defendants and carriers available. There is no way to know this based upon your query. It would be wise to seek a full review of this matter to make sure all issues have been covered properly, ec, etc.  There are time limits, requirenents and Statutes of Limitaion and Repose which may apply and could barr any additional recovery as wellas and in addition to your Release.... How do i get my money from my dad

Answered 5 years and 3 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Car Accident
Its not your money essentially, as your father is your legal guardian and controls it. For the same reason as he was obligated to pay for the medical insurance and medical care you recieved and didn't pay for. Unless this amount was over $5,000.00 where court approval was required, or unless that money is still in an account if you are an adult, there is no issue here. ... Read More
