That this occurred as you were following another vehicle simply adds to the problems in such a case. Your best bet is to have your insurance coverage fix the damage. If they are offering $250.00 on a $700.00 repair its simply not a legally viable case. You might ask to check any exit video they maight have to show what happened if you thnk that will help. ... I recommend that you keep insurance on the vehicle for as long as you are the owner of the vehicle.  Under Florida law, the owner of a vehicle is responsible for any damages caused by the driver of the vehicle.  So, as long as you own the vehicle, you are legally responsible for the vehicle.  You should consult a divorce attorney asap to see if the vehicle can be returned to you or, in the alternative, title transferred to your husband as part of a divorce settlement.... If your Geico policy was in effect on the day of the accident, that policy would still apply to any claims related to the accident, even if you canceled the policy after the accident.  You should contact Geico and ask if they will provide you with a defense and coverage for the lawsuit. It is possible that you did not have the right coverage on the Geico policy to protect you from the claims being made in the lawsuit.  Bodily injury liability coverage is the coverage that applies to injury claims that are made against you when you are the at-fault driver.  This is not a required coverage in Florida.  (It is ridiculous that this coverage is not required in Florida.  It is required in nearly every other state.)  If Geico tells you that you did not have bodily injury coverage at the time of the accident, you should consult an attorney to discuss the situation.... This isnt a drivers license lawsuit. Its  lawsuit for damages against you for the losses someone else suffered in the crash. Seems like no one on the other side is buying the "no permission" story and the other people who were damaged or thier insurance carrier are suing you to force you to prove it. Most likely the will be looking to get you to claim the vehicle was taken without permission, so they can leverage a grand theft auto case against your BF, since you will be essentially testifying under oath that he stole your car to avoid liability. If you receive a settlement for medical and, pain and suffering after a car crash; which was not my fault, can I sue the at fault driver?

The auto loan documents you recieved the day you purchased the vehicle often contains langauage stating whether you also purchased GAP insurance. GAP insurance is designed to pay-off the auot loan on a totalled vehcile in instances such as these. Search for and review your loan/finance documents to obtain this information and file a GAP claim immediately. If you do not have those documents anymore, return to the dealership where you purchased the vehicle and request a copy containing information upon any GAP insurance. Furthermore, the settlement you recieved from this accident should have required your signing of a written release in order to recieve settlement funds. Review the language of that written release because it should provide insight on whether you are able to continue any legal claims against the at fault driver as these releases often contain terms barring any subsequent claims against the insureds of the insurance company paying out the settlement funds. Contact the auto insurance company you had two years ago and report the law suit immeditaely (do not wait). If you had bodily injury coverage and not just necessarily porperty damage coverage (e.g. PIP/PD) alone under your insurance policy two years ago, the contract you signed with the auto insurance company when you obtained the insurance should stipulate that they will provide you with counsel to defend against any legal claims for bodily injury and/or property damage such as these. Also, auto insurance companies require by contract that their insured promptly report accidents as a pre-condition under the insurance contract. Failure to do so two years ago may be a problem.
