Why would there be hesitation in swearing under oath what you jusyt claimed above to be true? If there is reluctance that starts to sounds like the "no proof = dindoo nuffin" defense which is NOT the same.

Sorry but they won't let you have it both ways. If you want to claim he stole the car to avoid personal liability they will require you act accordingly. Otherwise, they are wise to the "he took it without permission" (stole it) excuse to avoin injury and insuance claims issues and then balking and criminal prosecution because of collusion issues. You are never well served to play games with insurance carriers especially making agreements and claiming crissed fingers. ... Read More

Hello. The questionnaire and affidavit are standard documents a plaintiff's lawyer will commonly request be completed by an at fault party to an accident. Although an at fault party(ies) cannot be compelled to complete this questionaire and affidavit without a court order, I would highly reccomend you consult with an attorney should you decided to fill out and submit those. There are no consequences to refusing to complete and submit the questionnaire and affidvit at this point in time. Since you stated that you have $25K/$50K of insurance coverage, your auto insurance company under terms of the insurance contract with you and/or your son is obligated to legally represent you and/or your son in court to defend the case should it proceed to litigation.     ... If the other driver was at fault and he has liability insurance, then you can file a claim. Retain counsel  here in Florida for contingency fee representation which means you don't pay anything unless you win.

If they wont respond immediately - report it to your insurance . If you are that worried about the rates going up - fix it yourself and move on. The notion of suing in small claims court is NOT like Judge Judy or Peoples Court.

Can she sue me?

Answered 6 years and 4 months ago by Steve Louis-Charles (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
Sorry to hear about your accident. Because you and your daughter were awarded by the negligent party's insurance company it is unlikely that she will be able to recover any further compensation towards her injuries. The release agreement that you were asked to sign before the insurance company issued you both a check contains language eliminating the beneficiary's ability to sue after accepting the check. In case you still have a copy of that you should review the language contained within for better clarity. Hopefully this answers your question.... Read More

There is no "help for cheap" when you are being sued for breaching some $50,000.00 loan agreement. You will need to put on the big boy or big gurl pants, hire a lawyer to defend the lawsuit and go from there.

Should i go to court or no?

Answered 6 years and 7 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Car Accident
This doesnt sounds right. Its more likely you are being sent a letter by her insurance carrier seeking payment from you before they sue you for subrogation. if she was being sued by her insurance carrier for fraud, its unlikely you would even know let alone be involved.
