You can win in court, and there is no better lawyer than a parent themself. A competent and aggressive attorney can certainly get the job done. But you have to differentiate between the attorneys. There are attorneys out there that says, yes I can get you full custody, without even knowing the full facts of the case, they just want your money and bill you high hourly rates to eat up your retainer and then pressure you to take the settlement deal or whatever is easy to get, regardless of what you wanted. And than there are attorneys like in my firm, where we review the case, figure out if and what we can do and how much it will really cost, because we don't pressure our clients to settle on a case we fight aggressively to make sure what we want to be done comes out the way we. Just make sure, who you hire as your lawyer since it will determine the results of the case. You could be left with your kids, or you could be left with a negative bank balance and high attorney costs and not what you hope to get. Please keep in mind that not all lawyers are same. Hello, Your son does not wish to be transitioning from one house to another, and you mention you do not have court-appointed custody. What I am assuming is that you guys never went to court for the child custody matter and work with one another to establish 50/50. What may be possible since you guys are working and very cooperative, is to try and talk to him if he will be willing to do in-house visitation, where he will be able to come to meet with the child as that would be the best interest for the child. If he does not agree then you should contact an attorney to start the court litigation process to establish by the court such arrangement which will be beneficial for you and your son.  Please keep in mind that not all lawyers are the same, therefore be very cautious as to which attorney or law firm you chose to work with. if you cannot reach an agreement with mom, you have to file a petition with the court and ask for partial custody or visitation.  there is nothing else - either you reach an agreement with mom or you ask the court to decide when and how often you will see your child. each county in PA has a specific procedure that you have to follow when you file that kind of a petition so make sure you either hire a loweyr to help you, or be very careful about following your county's rules. if you don't follow the rules, your case will be dismissed and you will have to start all over - a waste of time and money.  ... Courts decide custody cases by using a 'best interests of the child' standard.  they look at a lot of different things to decide what is in the child's best interests.  certainly an important factor (but not only only factor) would be that one parent is not willing to take care of the child and has left the child in the other parent's care.  have you thought about trying to get mom to sign an agreement that says dad can have primary physical custody of the child but that mom can be with the child on some kind of a schedule that you all agree to?  when one parent moves away and leaves the child with the other parent, there is often an oportunity to reach an agreement that the court would be more than happy to imiplement.  you should consult with an expereinced custody lawyer in your county.... i'm not sure i understand what you mean by ex-parte.  if there is a court-ordered custody agreement in place, then to change it, you have to file a petition with the court asking for the order to be changed (modified).  if there is only a private agreement in place, then you can tell your ex that you no longer agree to be bound by it.  that will probably result in  anger and chaos, so be prepared to go to court and respond to your ex's custody petition,  and maybe the police at your door, or you should file you own custody petition asking for a custody hearing to determine everyone's custody schedule.   you should talk to an experienced family law lawyer before you do anything that will have a negative impact on your rights and obligations....
