How can I see my son and do I have right to know her address

Answered 10 years ago by Ms. Christine Marie Santana Bechtold (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Support
It sounds like you need to legally exercise your parental rights. This would include a statement by the Court establishing you as the Father and then providing you with visitation rights to see them.  Right now, I suggest you keep a log of all contact you have with the mother and anyone else who may have information on their location. Once you have a good idea about where they are, you can have your Petition to exercise your parental rights served on her. Christine@Bechtold-Law.com... Read More

Answered 11 years ago by Ms. Shonda Michell Ball (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Support
You would still have the obligation to support your child, even if you were not working.  It is based both parents' income, among other factors.

Each State has its' own laws considering residency. The State of Florida, where I am licensed, has a six month waiting period prior to becoming a resident of Florida. I would suggest you contact an attorney in your area so that they may advise you of the residency requirement in Georgia and the anticipated cost of representing you should you decide to utilize an attorney in this matter.... I have a court order for child support im. o remarried with a newborn baby where do I go for modification

Answered 11 years and 9 months ago by Ms. Daniela Kristabell McCalla (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Support
To bring a petition for modification of a child support award, regardless of the length of time since the award was established, there must be a substantial change in either parents’ income and financial status or the needs of the child. O.C.G.A. 19-6-15(k)(1).             The substantial change in income can either be an increase in income or a decrease.             A petition for modification of child support has to be filed utilizing the same procedure followed when filing for a divorce.  Therefore, venue and jurisdiction has to be considered.  One has to be mindful of the state and county when filing. The Defendant (the party that isn’t filing the modification) has to be served with the modification documents.             During the hearing, testimony and evidence can be introduced concerning the change in circumstances, income, and financial status of either parent.  Evidence and testimony concerning the change in the needs of the child can also be introduced.             It must be determined that since the previous award for child support was put in place, there has been a substantial change.             After hearing evidence presented by both parties, the court may modify the previous award, if the evidence proves that a change warranting a modification has occurred.  In addition, the court considers whether a modification will be in the best interest of the child or children.             If a modification is warranted, the court will enter a written order specifying the basis for the modification and include all required information.   If you would like a child support modification, please feel free to contact me. Can both parents agree on a amount of child support in Georgia or do we have to go by the worksheet?

Answered 13 years ago by Antonio B. Mari (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Support
You need to go by the worksheets. The number one issue in getting your divorce kicked back by a judge is the child support worksheet. There is room in the worksheet to do deviations, but that is a discussion you need to have with an attorney in person. The laws on deviations are too much for this forum.... Read More
