What are my options?

Depending on the amount you should be refunded, you can sue in Small Claims (up  to $5,000. in CT) or in Superior Court. If you sue in Superior Court, you can also sue for specific performance.  I would need more details but if you would like to discuss options further, my office would be happy to consult with you and look further into this matter. 203.870.6700... You did not give enough information to answer the question. An employer does not have to keep a job open after you are injured and unable to work.  However, they cannot take retalitory action against you for filing a WC claim.   If the employer can point to technical reason for terminating you, they will probably prevail unless you can prove that the technical reason was completey made up.... If you are found in default, you may still have time to cure the default by filing the appropriate paperwork, whether its an Appearance or Answer.  If you have a defense than you should get on that immediately. If you do nothing, as presumably you have thus far, the case will continue to judgment against you without you having to do anything.  Please feel free to contact us for further information.... If their case was dismissed they are not going to get costs. If you counterclaimed and your claims were dismissed they might be able to make a successful motion.  The way this question is written, it is impossible to understand what actually happened or to give a proper answer.

Can I sue a dealership for my stolen car?

Answered 6 years and 6 months ago by attorney Bruce Robins   |   1 Answer
You can sue the dealership for negligence, but I don't think it is a slam dunk.  I think different people could have different opinions s to whether the dealership acted reasonably, given that the building was locked and (presumably) this had proved to be adequate security in the past.  Also, I'm assuming that you had insurance that covered most if not all of your loss, thus most, if not all, of any damages you recovered from the dealership would go to repay the insurance company.  Indeed, the insurance company may decide to file a direct claim against the dealership, independent of you.  If you didn't have insurance, it's a different story, and the upside of suing probaly outweighs the downside.... I would contend the condo association is on the hook for the bill, not you, unless you caused a different issue that could have causal connection with the destruction of the door.

You can always sue someone, the question is whether you will win.  Here, since it appears that you have no other evidence, it appears that it will be your word against your roommate's, with no guarantee as to whom the Court will believe.

Forgery is a crime, and the local prosecutor may be interested in prosecuting if you want to press charges.  For a civil suit of this type, however, you must be able to show damages.  Thus, for example, if they forged your signature on a contract, you can sue to invalidate the contract.  However, if the forgery did not cause you damage, for example if your name was forged on a document claiming that you are the new owner of a vehicle, which is true even though you didn't sign the document, you would not have a civil claim.... may I be an expert in my own civil trial?

Assuming that you qualify as an expert, and the issue is one on which expert opinion is admissible, yes.  However, juries and judges typically pay far more heed to the opinions of experts who are not personally involved.

In my opinion, you need a seasoned litigator with experience in civil and criminal litigation.  Someone who understands the case that has already been adjudicated and has the ability to properly utilize the case file in civil court would be very useful. Our firm regularly handles all varieties of both civil and criminal litgation and would be happy to discuss the matter further if you like.  Regarding a counter-claim, I would need to know more about the facts of the case and how events played out. ...
