It could be because the current political climate in California is going very soft on criminals as opposed to how criminals were treated in the past. I would contact the prosecutors office and demand a sit down meeting to go over your case.

Do I have a case?

It appears that your son is well-adjusted and you know how to handle him.  Other than a "disturbing mood," I do not see any "damages" from your story, i.e., did he have to go to the hospital, does he require more therapy, OR are you the one damaged, OR was there any physical injuries.   In other words, did you have to expend any "out-of-pocket" money for his care and recovery?  If not, then you have no case to be filed in court.  This world is not perfect and things happen which may be no one's fault.  You should be lucky your son was not injured.... Yes you should file a legal malpractice case against him. Hopefully he has insurance coverage, and if he does the insurance company will most likely negotiate a settlement. You need to retain Consel immediately so that you can file a claim. Your case would be strong if the underlying action has strength. So discuss in detail with counsel About your case in a private phone call. Some of us take these cases on contingency fee, which means you don't pay anything unless you win.... Read More

I have a medical condition and was told I couldn't use the rest room at circle k and the restrooms were open and I went on myself

Answered 5 years and 2 months ago by NA roseann@frazeelawgroup.com (Unclaimed Profile)   |   1 Answer
I'm sorry that happened to you.  Circle K is a grocery store?  I don't know of any law requiring them to let you use its bathroom.  However, I would suggest if you have a problem, you might consider wearing an adult diaper if you are going to be away from a bathroom.  Most elderly citizens have to wear diapers.   ... Did your mother teach you:  "Sticks and stones will break my bones, but words will never hurt me."  I don't know if you are a man or a woman but it really shouldn't matter.  (1)  You could definitely file for a "civil harassment restraining order," meaning she could then face criminal charges if an order is granted and she continued to harass you when you are merely doing your job.  You could merely call police and have her arrested.   (2)  If she is trespassing on your property, then you could file a civil complaint for any damages she causes including emotional stress.  However, you should know that judges and juries hate neighbors fighting cases.  So you would have to show severe emotional problems such as an expert witness psychiatrist testifying, medical expenses and lose work damages as a result or some type of monetary loss.  A civil harassment restraining order may be the easiest court filing against her to get her to stop.        ... if the towe company does not want to give me back my stuff from vehicle, can i get something in writing from courts?

Answered 5 years and 3 months ago by NA roseann@frazeelawgroup.com (Unclaimed Profile)   |   1 Answer
The towing companies are usually glad to give you your personal items.  They usually don't have any need for those items and encourages you to pick them up.  If, however, you don't get them back from the towing company and you properly asked for their return, you can file a small claims action if the value is under $10,000.  You will have to prove the value of the contents.  However, before you get too upset, try to get the items back from the towing company.  Good luck!  ... Usually the courts do not compensate anyone for "hurt feelings."  On the other hand, if she developed serious mental problems as a result and was seeing a psychiatrist, then you might seek damages for the psy bills.  Unfortunately, people are rude to about anyone.

You should consult counsel in your state about applying for a restraining order. If she violates it,  she gets arrested. However, more facts would be needed to know to determine if a court would grant it.

Answered 10 years and 11 months ago by Robert John Spitz (Unclaimed Profile)   |   1 Answer
This could be the basis for a restraining order.   The forms are simple and you can generally do it yourself without the assistance of an attorney.   There is no filing fee. If you think she is going to contest it, you might want to get counsel.   Robert J. SpitzLaw Offices204 N.
