If you fall behind 3 times, thats exactly what gets reported to the credit bureau. Not sure about the other issues as a lawyer would need to review the contracts to address cancellation of other products like GAP issues.

If you were charged for a product not received there is an issue to address. If this is about no present for Christmas, that is NOT a viable claim. In the future you should know better than to shedule delivery of such an item the day before Christmas.

You are going to have to sue.  The court will be determined by where you bought it, and how much you paid.

Is there any law to make seller refund my money back?

Answered 6 years and 5 months ago by attorney Hon. Max L Rosenberg   |   1 Answer
Caveat Emptor- buyer beware.  There is no way to make them give you a refund under the circumstances you described.  You are expected to do your research before the purchase. However, I too have been suckered in by a couple of those kiosks.  I feel your pain.

If this is a reputable bank, I'd have to imagine by now it has conducted an investigatin, fired those involved and notified its fidelity insurance carrier of the criminal act.  If so, I'm sure the insurer is simply conducting its own investigateion before it returns your funds to the bank.  If the bank doesnt return your money soon, you should probalby have a lawyer call on your behalf.  Would be happy to discuss with you further.... NIce try - but be careful playing the "incompetent grandpa/ma" card as means to get out of contracts on what is really buyers remorse. The immediate response to that when litigation ensues is to seek a mental health examination and if you claim you are too feeble minded to make a contract and doing so is exploitation, you equally feed the notion that you need a guardian at litem to manage your finances and affairs or to be instiutionalized for such. Can't have it both ways where you just play that card everytime you make a deal you don't like. That said, there may be other legitimate issues in regard to the contract that need to be addressed but you will likely need to retain a lawyer to review the documents and intervene. You can try legal aid otheriwse if you qualify but they rarely get involved in civil conract litigation issues. ... Read More

False Advertising

Answered 6 years and 7 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Not likely a fraud case from a general advertisement as it is a general non-specific statment. Absent a written warranty, you might have other remedies such a UCC claims for specificl limited warranty, such as "fitness for use" but the problem there is the expense of hiring a lawyer to sue over the issue and I am willing to bet the vehicle at issuse is a sub$5,000.00 "hooptie" type car with high mileage purchased at a buy here-pay here type dealer. The problem with a cracked head may ultimately come down to what happened when the car "broke down", as hopefully the ECU will not show that you continud to drive the vehicle when the lights came on or when then temperature gauge was in the red. ... Its impossible for any lawyer on line to respond to " I asked a guy and he told me...." You will need to actually RETAIN, not consult with a lawyer to review your documents and go from there. There is nothing inherently illegal about a home based business, it would be the other issues that created the problem. ... Read More

Obvioulsy there are other facts in play here that have not been revealed. If you are being accused of fraud you will need to spend the money to lawyer up, with a civil lawyer and possibly an additonal criminal lawyer. Typically these issues occur where your card is used for purchases in a manner that triggers a fraud profile. Like using a $500.00 limit card in a series of transactions designed to get vendors to sell you items and then close the card, as one example. ... Read More

Is this fraud?

Answered 7 years ago by attorney Mark Tischhauser, Esq.   |   1 Answer
You can't have it both ways, where you want work performed but refuse to authorize it writing in some fashion. You will need to address this issue with the manufactuer or the warranty company. Obviously you should not be expected to agree in advance that the repair work was properly done, but such verbage on a estimate alone may be of little conseqeuence. Its impossible to address this issue based upon a single sentance cut out of an entire form.... Read More
