You need to protect yourself and your interests much better.  You should start by consulting with a divorce attorney as soon as possible.  You should keep an eye on all of your assets. You should be prepared to call the police if this guy is harassing or threatening you.  And you should consider recording your interactions with them in case they are considering a restraining order or somehow framing the situation to make you look like you are violent or attacking them.  I would also advise you not to interact with them as much as possible and avoid any conversation with her lover. It depends on the length of the marraige, your earning capacities, and a number of other factors.  However, the debt may be shared or allocated.  Of paramount importance, is your wife considering her options for debt relief.  Depending on her situatiion, a chapter 7 bankruptcy can likely erase all of that debt.  If you have debt, you might even file a joint bankruptcy prior to the divorce to save on attorney fees. I am not a California attorney nor have I ever been licensed to practice law in California, however when my father in law had a similar situation in New York, I know my wife would fly him out of New Jersey just in case. The answer is, I am not sure but the posibility it extremely real. I would suggest seeing an attorney experienced in family law before making any major decisions.  Perhaps you should also look into divorce mediation. You can save an enormous amount of money, time and stress if you and your husband can mediate. Once you file for divorce, there are automatic orders that take effect. One of these is that neither party can sell away marital property. However, I don't think it would be a problem as long as you and your spouse are in agreement on the sale and the nature of the distribution of the proceeds. Do not waste time and do not handle your life out of order.  See the attorney, speak to them about the situation and then make the decision and follow through.
