Real simple. As long as you live here in the date of filing and for more than 90 days prior to that date, you can file here and obtain a divorce. There is no requirement that he live here also. If you want to resolve other issues, such as maintenance and property division, then other issues pop up. There is no rule. In theory enough time where money has been contributed into the pension or 401k during the marriage is sufficient. But there is a cost to that right.
