Consider talking to a lawyer who handles adult guardianship cases. Perhaps a legal guardian could help her stay on her treatment path. Otherwise, you could start a divorce process but you may end up supporting her and dealing with an issue where she needs a guardian in the divorce. No. Sorry, but the child support laws allow the petitioner to file in whatever state you live - so since you live here, you are subject to the state laws. If your child is emancipated under New York law, then you can file to stop paying. Good luck.

I think you answered your own question: if you believe he is interfering with her speech and development, then you need to make a motion to change things, particularly if he hasn't done anything for six months with respect to the early intervention.
