If I have a lease that doesn't expire until 12/1/16, can the apartment complex raise late fees anytime they want?

Answered 9 years and 10 months ago by Dean P. Valente (Unclaimed Profile)   |   1 Answer
Yes & no... doubtful they can raise fees specified in lease mid-term w/o both sides consent. If they assess higher rate simply object. However, such a minor change does not generally give you cause to breach the lease in such a material way. If you are not late w rent very iften let it go...if you want to make an issue write a letter & object to the unwarranted increase...whimsically you can notify them that you've unilaterally decided ro cut tour rent by half perhaps they will recognize the error of their way. Of course, none of this may matter if the lease allows for changes with justification, upon written notice. Otherwise they will have to wait until next renewal.... Read More

How long do I have to move out after an eviction notice?

Answered 9 years and 11 months ago by attorney James E. Reed   |   1 Answer
Probably a few weeks. First, there will be a court hearing that you'll receive notice of. You can attend that hearing and request a 1 week adjournment. Next, after the hearing, a Judgment will probably enter. That Judgment will give you 10 days to pay the rent due or move out. After the 10 days, if you haven't moved or paid the rent, then the Landlord may file with the Court a request for an Order of Eviction. It will likely take a few days for the Order of Eviction to be issued and delivered to the local sheriff. Once the sheriff receives the Order of Eviction, the sheriff will come to your residence and ask you to move. The sheriff will likely give you a day or 2 to move before forcefully throwing you out.... Read More

When can I move out with no lease?

Answered 10 years and 3 months ago by attorney James E. Reed   |   2 Answers
You were a month to month tenant at best. You gave 1 month's notice. That should be good. There is an argument that you owe rent through Jan. 15th because that's your rent payment date.

There are at least 2 choices: (1) tender payment of the balance [sending letter stating you are prepared to payoff balance] and don't make any further payments, or (2) send payment of the balance. Under (1), the seller will eventually start a law suit against you to forfeit the contract and at that point, the seller will need to give you a deed in exchange for payment. Under (2), after you make the payment, if the seller doesn't give you a deed, sue the seller for performance.... Read More

Can he sue for any punitive damages if we were to move out only 3 months into a year lease?

Answered 10 years and 7 months ago by John F Brennan (Unclaimed Profile)   |   1 Answer
You will be liable for the rest of the lease, at least until it is re-rented. The landlord has a right of free speech, even if it is vile and hateful. Plan to move, on time or with permission. If you want to move just ask your black friends to visit consistently and the landlord will be pleased to release you from the lease.... Read More

What can I do to fix water damage if I do not have insurance? How?

Answered 10 years and 7 months ago by Georges Herman Shers (Unclaimed Profile)   |   3 Answers
I assume you own the unit and are not merely a tenant. Find out what caused the leak [was it improperly installed so you can sue the plumber who put it in], was it from your water heater or one shared by the building owners, get written estimates as to the cost of repair, etc. If the cost of repair they claim is reasonable, that you can not afford it does not eliminate your responsibility to pay for it.damage; see if you can work out some type of settlement plan with them.... Any buyer buys subject to your interest unless your lease states otherwise or if you signed addendum or subordnation letter. A lease is an interest in real estate just like a deed. Exceptions exist like if it was a foreclosure.

What should I do if my mother-in-law wants to be on deed of house? How?

Answered 10 years and 7 months ago by Georges Herman Shers (Unclaimed Profile)   |   2 Answers
A mortgage does not show ownership, it shows you borrowed money. You need to check that the bank would lend you anything with her not being a co-signer on the loan as normally they would not [if she owns 1/4th of the house, then the bank can only look to 3/4th of its value to guarantee their loan to you, and they will not lend you more money than the value of your interest is in the property, and normally they are not allowed to lend more than a certain percentage]. She also is responsible for her percentage of the property taxes, but the county will look to you for the full amount as they do not take partial payments. In any such agreement, you need to spell out in writing what everyone's duties are, how the house can be sold, can she transfer her interest to someone without your permission, what are her rights of usage [all owners have the right to live there and can not be charged rent absent an agreement to the contrary]. What happens when she dies to whom does her interest pass, will you have to sell the house, etc. You both have to think very hard as to whether you want this type of arrangement [as opposed to her just having a second mortgage that is acceptable to the primary lender]. Speak to a local real estate attorney as such a deal can become very messy.... Read More
