You may have a claim. To prove negligence in a fall down case you have to prove that 1) there was a defect and 2) that there was adequate notice of the defect and it could have been corrected. You have to prove that the failure to reasonable protect you caused your harms and losses. The defense will argue that you were more negligent than their client.
