In order to do so, you need to show damages and liability.  To show damages you need to be able to produce medical records and/ or doctor notes illustrating your mother's injury. First check your homeowners policy. Most exclude coverage for injuries to someone hired to work on your property on the idea that they will have workers compensation insurance. As you may have no ins coverage Make sure they do. Don't provide the worker with any tools or control the work other than contacting for it. You can attempt to have them sign a release of liability before starting but that does not always work or hold up. You may have a claim. To prove negligence in a fall down case you have to prove that 1) there was a defect and 2) that there was adequate notice of the defect and it could have been corrected. You have to prove that the failure to reasonable protect you caused your harms and losses. The defense will argue that you were more negligent than their client.
