Should I sue my doctor for not telling me of this life-threatening disease?

Answered 8 years and 10 months ago by James Peirce Kelaher (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Thank God you obviously found out before you died! The mere fact that you had to wait to have the corrective surgery is not, in and of itself, actionable.

Is there a possible lawsuit for an inmate bitten by a recluse spider not seen for 5 days?

Answered 8 years and 11 months ago by James Peirce Kelaher (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Probably not, unless you can establish that the prison was aware of a spider infestation and did nothing about it. Decades ago, I sued an apartment complex in south Orlando because a tenant was bitten by a spider, but in that case my client and her neighbors had complained on many occasions to the management and they never did anything about it.... School injury

Answered 8 years and 11 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Personal Injury
Its not clear from the post what you expect the school to do. You transferred your son to a different school, where presumably he should be no longer "terrified." Unfortunately, in the guise of "acceptance and inclusion" most school authorities have essentialy been neutered so that its virtually impossible to demand "they do something" in your situation only to be confronted with threats or claims by the other childs parents. At this point the problem is solved, though you will suffer inconvenience, for the safety of your child. If you insist upon escalating the issue further you can but you will need to plan on spending a good deal of money on legal counsel to do so. ... Read More

No - you have no standing to do so.
