You probably have a good case. Remember to seek medical attention ASAP so that you can document your injuries, don’t speak with or give a statement to the other side or their insurance company, and retain counsel here in Florida. I have a lot of experience with maritime accidents. ... Read More

Do I have a case to pursue ?

Answered 8 years and 4 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Personal Injury
Yes it’s possible. However you must show that the store was on notice of a hazardous condition that foreseeable could result in a slip and fall, and failed to eliminate that hazard. Did the fall happen at night? Did you take pictures of the hanger to show the hangers condition and were there witnesses? These and other questions need to be explored prior to making a determination about the case... Read More

Other than reading like a bad haiku - its impossible to tell what your issue is or questions are. You may just do better calling a local injury lawyer and expalining what happened and what your issues are.

Unfortunately, this falls into the assumption of risk category along with self inflicted/comparative negligence issues. Absent some catastrophic injury, like blindness or substantial surgical intervention, that financially justifies pursuit of a claim, you wont ind many lawyers willing to pursue such a case on a contingent fee and payment of an hourly rate/retainer might be cost prohibitive. ... I can assure you that the lawyers had no difficulty "getting ahold of" the school or its insurer. The problem is likely the school wont pay what you want and the lawyers dont see the value in the case that they will spendthe money to put on a trial. There is no "fix" for this other than reassessing the settlement propects or possibly you agreeing to fund the expense of trial to see what a jury says. ... Read More

I'm sorry to hear you have been injured using a hard wax product. If you have been injured using this product, in a manner as recommended by the product manufacturer, than you may have a valid claim.  If your injuries are minor and you are not going to need ongoing or future medical care for your injuries, you may want to contact the company directly and advise them of your injuries. they will probably pay a nuisance payment to you to make your case go away quickly. If, however, your injuries are substantial, you should contact an experienced personal injury lawyer and let them handle negotiationg with the insurance company of the product manufacturer. Make sure you keep the product and take pictures of the progression of your injuries every day until they are healed.   Good luck, Christopher R. Largey  ... Read More

What type of lawyer works on illegal government survalliance

Answered 8 years and 5 months ago by attorney Christopher Largey   |   1 Answer   |  Legal Topics: Personal Injury
Withou any more information, it is difficult to determine what type of case you are dealing with.  If the gov't is prosecuting you based on illegally obtained wiretaps, than a criminal defense lawyer needs to be retained to file motions to have the evidence suppressed.  If you are concerned about information obtained in an illegal wiretap and there is no criminal case against you, than you need to talk to a personal injury lawyer who can evaluate your case and determine whether the damages that you have suffered warrant a claim against the government. If you were a little more specific about the issues related to the "illegal surveillance," it would be helpful in determining your legal issue.   ... Read More

Case been too long lingering, Can I enforce Lawyer to go to trial?

Answered 8 years and 5 months ago by attorney Christopher Largey   |   1 Answer   |  Legal Topics: Personal Injury
Anonymous: It sounds like there is a communication issue with your present attorney.  Schedule a face-to-face meeting with your lawyer and find out where in the litigation process you are.  Since your case is 9 yerars old, it appears that your case has been in litigation for some time. Either your case is very complex, or there may be logistical issues that has caused the delay in getting your case in front of a jury, or there may be other issues. The best and only way to determine what the issues are, is to discuss your case with your lawyer.  It will be difficult to find a lawyer at this late stage to take over for your current lawyer, as the SOL has run.  If your lawyer is hesitant to try your case, there has to be a reason. He or she should be able to articulate to you why he is hesitant to try your case. Good luck to you.   CHristopher R. Largey         ... Read More

Legally - there is a strong argument the answer is yes as it was your negligence, at least in some part, in not closing the door allowing the dog to get out that caused the event.

#1 - If what you say is true, MOVE. first and foremost, and do so immediately, even if you have to break your lease. There is no restraining order that stops bullets. if he persists at that point, it will be MUCH harder for him to jusitify being in another town or across town bothering you and easier for a judge to enter a restraining order. To be clear, you really need to spend the money to hire a lawyer to address this. ... Read More

Can I file lawsuit for slip and fall injuries for negligence claim?

Answered 8 years and 8 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Personal Injury
This is a problematic case - as there is a clear degree of comparative neglience/assumption of risk - when you expect to hold someone else liable because your fell in a wet bathtub/shower. Absent a substantial injury - which I didn't see described - this is a very very weak case. To the other end, if you suffered some catatstrophic injury, which I hope you didn't, the consideration for fighting through the comparative negligence issues may become stronger. ... Read More
