You most likely have a case. Discuss in private with counsel here in Florida. Martindale rules prohibit us from soliciting your case, but u may reach out to one of us. It appears that you will need to file suit to get the case moving along, so make certain that the person you hire will commit his time and his/her firm's money to effectuate that. My firm finances all the case costs and we do not require any reimbursement unless the case settles and you win. ... If this issue is over $1,000.00 depending on the case value this may or may not be worth creating a controversy over. I fyou feel the lawyer botched htings up you can make a complaint with the Florida Bar about the issue and see if they can help resolve it.

Can my attorney hold back my lien money?

Answered 7 years and 11 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Personal Injury
Actually you have no right at all to be in the lawyers office client or not. Keep that in mind so you dont find yourself arrested. That stated, obviously, you have a bad relationship with the lawyer and it is likely that you will need to retain a new lawyer, likely at some exepense out of pocket to intervene and figure out how to address the issues with the first lawyer. Unforunately, complaining about overisghts and issues AFTER a settlement, and worse, if you are demanding some form of fee reduction or consideration is always problematic and the source of controversy. IN the future address these issues during thecase. ... Read More

If you have been in a lengthy civil case and there has been an appeal, it sounds like you must have had counsel. It does ot seem like something that could be done pro se and still need assistance with this question. It seems that you have legft out pertinent facts including your attorney's position in this regard.   I suggest you retain counsel immediately.... Read More

Technically you might have a case, assuming there is good evidence to prove they were negligent.  However, with minor injuries, many personal injury lawyers would be unable to accept the case.  The reason is that the time and expense in litigating make it difficult for us to handle cases unless the recovery is likely to be large enough to pay for that time and expense.  But, you should consult with a lawyer near you, because we cannot know enough about the facts to give you a reliable answer online.  Please do not rely on this answer in making your decisions.  Best of luck to you! Do I need a personal injury lawyer?

Answered 8 years ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Personal Injury
Probably need to hire a lawyer - if one will take the case under the facts presented. Mutual combat/physical attack cases between patrons are very tough cases and absent an arrest and some serious injuries from a collectable defendant, most lawyer will have little interest.

You will probably find that the problem is that you filed suit"pro-se" or an earlier lawyer withdrew  and are claiming catastrophic injury damages that may be very very hard and very expensive to try to relate to a mold issue, such as "brain growths" and tumors. This will bemademore problematic if you are, as typical,  looking for millions of dollars in damages.  You may have to hire a lawyer at an hourly rate/retainer to pursue such a claim or you are going to have to handle the case on your own. ... GreetingsI would like to know can I due my ex for emotional distress?

Answered 8 years and a month ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Personal Injury
Beggars can't be choosers as the old saying goes. Absent a court order otherwise, your EX has NO OBLIGATION to support or care for you, period, let alone be sued because you because you don't like it. That why they are the EX. You probably need to contact social services and see what they can do to help with any of several welfare programs you might be eligible for. ... Read More

I need a new lawyer

Answered 8 years and a month ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Personal Injury
You can hire a new one if you like but you need to talk to current one to express your concerns as you may find few lawyers wanting to pursue a slip and fall in general let alone one that is either in litigation or will soon be as the statute of limitation is likely to run soon.

Unfortunately this is price paid when getting convicted of felony criminal conduct and going to prison with other convicted felons. While there ARE instances when the DOC can be held liable, such cases are rare and few and far between for a variety of reasons ranging from unsympathetic plaintiffs to juries to inability to control all inmates at all times by DOC to the convict code regarding snitching that forces many witness and victims to claim they fell in the shower to avoid retaliation. You will likely need to hire a lawyer at an hourly rate/retainer at some expense to meet with him and review the issues, see if he is willing ti pursue a civil case and go from there. There may also be some effort to seeka transfer to another wing or location if there are defined risks or exposures for some reason. ... Read More

Hurt at a gym

Answered 8 years and a month ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Personal Injury
Possibly - BUT you will need to have MEDICAL documentation that the poor instruction alone caused your injury and that there is a collectable entity or insurance that covers the claim. This would likely be a VERY difficult case to prosecute.

Sorry to hear about this and your mother's injuries. This is what would be considered a "products liability" personal injury case. Its tough to give advice on limited facts, but it certainly sounds like you may have a claim worth investigating further. It is worth at least reaching out to a personal injury attorney to discuss your options further. Almost all do this at no cost to you unless they recover for you. You can contact most attorneys on this site by clicking their profile which will usually give you a phone number and website. Also, these can be time sensitive so the quicker you reach out, the better.     ... Read More

Its usually very difficult for a new lawyer to come into a case where the first lawyer and the client got all the juice from the first 2 settlements and the new lawyer is expected to eat the rinds and do the heavy lifting. Your best bet is to get a complete copy of your file and hire a lawyer, probably at an hourly rate and retainer of some sort, to review the case and figure out what you have to work with andgo from there.  ... Can I sue a restaurant for serving food which caused me to chip a tooth?

Answered 8 years and 2 months ago by attorney Joel P. Williams   |   1 Answer   |  Legal Topics: Personal Injury
It is possible you may have a claim, but more information is needed. Most importantly, what are the extent of your injuries? If it is just a small/negligible chip of a tooth, its probably not worth pursuing. If it is something that caused more damage, or something that required medical/dental treatment, then it may be worth looking into further. I would reach out to a local personal injury attorney and give them as much information as possible so that they can evaluate further. Almost all with both consult and represent you at no cost to you unles they recover on your behalf. You can get attorney's contact information my clicking their profiles on this site. Good luck.... You will first need to obatin a written opinion that the actions of the first doctor, which you attribute to "common knowledge" rise to the level malpractice from another qualified Orthopedic surgeon.
