Your damages are limited to the amount you paid for the sandwich.  You did not eat it, so you were not physically damaged in any way.  The restaurant should have either given you a new sandwich or reimbursed you.  If it is a chain restaurant, I would write directly to the national headquarters and by-pass the local store.  Good luck.... you should have anything the person signed notarized, and you should get the person to sign a "release".  Do an internet search for a form release for a personal injury and use the langauge where the person is releasing you from liability and releasing any right he or she might have to bring a claim....
