This will all depend on the facts and evidence addressing your interaction with the officer and hopefully some video recording or other objective information. As you umay well imagine, people arrested or detained by police officers ROUTINELY instigate or escalate the issues and then blame the officers when they react. So your husband has a warrant for his arrest and you say he ran and sat on the porch to "wait for them?" really?.....why didnt he just stay where he was and get arrested?.....OH thats right, because people with arrest warrants out on them don't do that, the run away and try to barricade themselves in the house. if you want to spend money on a lawyer to purse such a claim, you simply need to retain one at an hourly rate/retainer and have this pursued. This is not a contingent fee case where you get angry and the lawyer fights your battle at tthier expense.

Lawyers cannot represent criminal defendants on a contingent fee basis. In your situation, I doubt any competent lawyer would take any potential civil case on a contingent fee basis absent an aquital at trial. Obviously, it sounds like some co-conspirators to a "capping" scheme have implicated you and these can be a huge problem in any civil claim of impropriety. LOL....this falls into the legal category of "fat chance". Assuming the cop violated FHP policy left and right, this would do nothing to get you a "clean record", if nothing else under the old adage of 2 wrongs dont make a right. If you are going to challenge this, you will have to spend a gooddeal of money hiring a lawyer to challenge the facts which may support that the cops actions were arbitrary, like 107 mph for both riders which is highly unlikely, and may damage his credibility for "pacing" you by showing he just made up a speed beause youwere going "real fast"... I guess the bigger question is "was your brother staying there or were you coverning for him".  If the cops had a warrant, which it sounds like, there may have been some basis for them to inquire. It doesnt sound like they were looking at misconduct by the children or taking testimony from them as witnesses or anything. If the only witness you brought to court was a "little off" on his testimony, and you didnt bring any of the witnesses you were aware of from your street, the judge beleived them and not you. Witnesses that are left at home and dont show up in court dont exist for legal purposes and are useless, you must ALWAY subpoena people that will help you for court hearings.... Read More
