Do I have a case in which my freedom of speech has been violated?

Answered 11 years and 8 months ago by attorney John M. Rogers   |   1 Answer   |  Legal Topics: Wrongful Termination
The Constitution and your rights under its various amendments protects you against Government action.  It gives you no rights with respect to a private employer unless Congress or the State of Texas pass specific laws giving you such rights. There is no general right of free speech in a private workplace.  Moreover, in Texas, an employer can terminate or discipline and employee for any reason or no reason (but not a reason prohibited by statute or contract), even if it is not spelled out in a policy manual. The description of your issue does not reveal that the employer did anything illegal.  ... Read More

short term disability termination

Answered 11 years and 8 months ago by attorney Matthew James Porter Coffman   |   1 Answer   |  Legal Topics: Wrongful Termination
You may want to contact an attorney and send your employer a letter requesting that they engage in the interactive process and provide you with the reasonable accommodation of 2-4 additional weeks beyond the expiration of your short term disability. In the letter, I would reiterate that you have been told you would be terminated if you were unable to return to work without restrictions following the expiration of your short term disability. It is important that your physician put the 2-4 week timetable in writing to your employer and not leave it up in the air as an indefinite leave.   Ohio Disability Discrimination Attorney www.mcoffmanlegal.com ... Can I file a lawsuit against at will employer in indiana for firing me for just being arrested for battery

Answered 11 years and 8 months ago by Mr. Christopher Edward Clark (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Wrongful Termination
Indiana is an "at-will" employment state.   Simply stated, your employer can fire you for any reason, as long as it is not on the basis of race, color, religion, national origin, age (over 40), sex or other retaliatory reason.  Your arrest for battery, even though there has been no determination of guilt, would be a legitimate reason for termination.... Wrongful Termination

Answered 11 years and 9 months ago by attorney Matthew James Porter Coffman   |   1 Answer   |  Legal Topics: Wrongful Termination
In Ohio, you may be terminated for any reason or no reason at all. Unless the reason you were treated differently was an unlawful reason, you do not likely have a legal claim against chipotle. If you think you were terminated for an unlawful reason you should consult with an employment attorney. You should, however, receive unemployment benefits because the analysis is only whether you were terminated for just cause which it does not seem like there was just cause in your case. I wish you the best of luck. Ohio Employment Attorney: www.mcoffmanlegal.com... Read More
