Yes, you probably are at fault because you had the duty to yield the right of way.  Just because someone does not have a valid DL and car insurance does not automatically make that person at fault for the accident.  Good luck with this matter.

I will presume that the owner of the truck did not give permission to the owner of the consignment lot to loan out the truck to others.  Therefore, the owner of the consignment shop and the friend driving the truck are both possibly at fault for the collision assuming that the friend caused the 4 car collision.  Good luck with this matter.... how can i prove my innocence in a car accident when the other person is lying but has a witness who is also lying with her?

Answered 12 years and a month ago by Eric Neal Schloss (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
I suggest that you consult with a traffic court attorney.  Unless you can find a witness that supports your version of the events, it might be difficult to prove your version of events.  You do not automatically lose just because the other driver has a witness that supports the version of the other driver but it makes it more difficult for you to prove your version.  Good luck with this matter.... I am sorry to hear of your father's death. If you have not already done so, you might want to consult with a Personal Injury attorney in the Richmond area because an estate will need to be opened at the appropriate local courthouse so that a Personal Representative can be appointed who can take over the claim of your father.  Good luck with this matter.... How can i recover the diminished value of my car from other drivers insurance company?

Answered 12 years and 3 months ago by Eric Neal Schloss (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You need to obtain written documented proof that you vehicle has a diminished value as a result of the collision with the tractor trailer.  This needs to be obtained from a property damage appraiser.  Try to find a company in your area that is willing to provide written documented proof or I suggest the following company: Reed Appraisers (301) 946-6116 www.Reedappraisers.com Keep in mind that some auto insurance companies will consider diminished value claims and others will not.  Also, some auto insurance companies are of the belief that you cannot have a diminished value claim until you sell your vehicle and then prove to the auto insurance company that the vehicle sold for a lesser price because of the vehicle having a diminished value.  But most insurance companies will consider a diminished value claim once you obtain a written report from a company like Reed Appraisers.  Good luck with this matter.... bodily injury and status of limitation

Answered 12 years and 3 months ago by Eric Neal Schloss (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
The adjuster is somewhat correct.  The statute of limitations in Virginia is two years from the date of the collision.  You have to settle your claim or file a lawsuit to protect your rights before the two year anniversary from the accident.  I strongly suggest that you immediately hire an auto accident lawyer in the city/county where the collision occurred to file a lawsuit to protect your rights.  Good luck with this matter.... You should read your auto policy.  It is my understanding that if your auto insurance company, Geico, believes that your son was at fault for the accident that Geico can pay the claim of the other driver and Geico does not have to have your permission to do so.  If you disagree with what Geico wants to do, you can double check your rights with the Bureau of Insurance in Richmond.  Good luck with this matter. ...
